My hubby took a call from a CA the other night (usually I deal with them but he answered the phone) Anyway, my husband kept telling the guy send me proof of this debt, something with my sig. (I was so proud LOL) anyway the guy was saying stop bluffing you KNOW this is yours BLAH BLAH BLAH. Anyway hubby got mad and started yelling at the guy saying he is a victim of fraud (which he may be, not positive yet) and hubby started swearing, well the CA started swearing back. Hubby said come to my house and say that etc and the CA called hubby a F*cking A$$hole and then hung up. I know hubby swore first but isn't the CA breaking the law?

    KHM,

I'm no pro, but the Fair Debt Collection Practices Act (FDCPA) states as harrassment or abuse, "The use of obscene or profane language or language the natural consequence of which is to abuse the hearer or reader," as per § 806. Harassment or abuse [15 USC 1692d].

You can see it online at http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm

    Hope this helps.
