I am so mad I am SHAKING!!!

    OK... I am trying to clean up my credit report myself. I just started last week. I have three medical collections from 1998 that are being handled by a credit bureau - CBS - who are a bunch of a$$holes. The combined amount that I owe then is $151. So I thought, I will call and tell them that I will pay this if they will take it off my report. The woman there was so mean to me - she just laughed and said "There is no way I am going to help you out. You WILL pay it and we WON'T take it off your record. People like you make me sick!!!" Well, I was just almost in tears. So I just hung up. Now I want to dispute these - just because she was so rude to me. Do I have a chance? Have any of you had luck with disputing medical bills? Thanks for any help you can offer.

    First of all, calm down. Send them a validation letter, then dispute it with the bureau at the same time. If they cannot validate the debt, they must remove it.

    You can get this off. I did-it took a while, but it was worth it.

    First rule of disputing w/ collection agencies---never call-do everything in writing. Don't subject yourself to this abuse.

    Do a search, use one of the validation letters here. Send it certified return receipt so that you can prove that they got it, and when they got it.

    That's a good place to start. Don't let these people get you down.

    First step is to calm down.

    Second gather your thoughts and make yourself very familiar with the Fair Debt Collection Practices Act (FDCPA) which can be found at www.ftc.gov

    Third, upon reading that find some letters regarding validation and cease and desist , you can find a few of them on the board.

    Finally:
    DO NOT CALL THE COLLECTION AGENCY ANYMORE, communicate with them in writing.

    Calling them will only aggravate you more and they are not worth it.

    Others may have some more tips but that is my suggestion and its not the end of the world because others have done it and you can to, so stay focused.

    I hate companies like that. They always think that they are trying to help someone. Personally the advice above sounds good, but this company is a business, who lacks any type of ethics or profeessionalism.

    Not that it would do any good, but I would complain. Forget the collection agency, I would complain via letter to the BBB, the original holder of the debt, of what ever professionalism business oversight committee you have in your community.

    Would it do any good in deleting the collections? NO
    Would it allow other people to see how they treat people? YES...and that should be the whole point. Disrupt their distrubution and allocation of potential customers and tarnish their business record.

    Please be advised that this is my opinoin, but they have no ethics, why should you?

    I know, I am starting to sound like (lbrown) Ha.

    So stop being the victim and stop being afraid, fight back. It's the American Way!!!!!

    Thanks everyone. I guess I shouldn't have called them, but I called another one just before calling them about a medical bill and they were so nice to me... I guess I just thought everyone else would be as nice. Boy, was I wrong!! I will send them a letter today. They do have to have something bearing my signature to make me liable for this, right?

    girlie: about the other agency make sure you get everything in writing before you send them any money, because sometimes the ones that are very nice is the one you have to be careful of the most.

    I did. The guy told me that he would send me a letter stating that they will take it off my credit report and as soon as I receive the letter, I could mail him the payment. It is a local company and they have a very good reputation. Someone once told me that medical collections HAVE to be taken off the credit report once they are paid. I guess that's not the case, huh?

    Sorry to hear about your experience. Count me as one who is still paying for a paid medical collection $120.00. Never got the bill for this, but paid it as soon as I saw it on my credit report, thought that would do it. Nope! Will be 5 years old in Feb, I think. It's still the #1 FICO reason on equifax (only one it's listed).

    Getting them to validate the alleged debt should prove whether or not they have anything that ensures that this debt is in fact yours. It should include details and amounts as to what this debt is for.

    FYI-a document w/ just the amount, without dates, etc. isn't validation.

    Just remember one thing:

    You hold all the cards - they want the money, they are HIGHLY unlikely to try and sue you for such a small amount and if they want to be paid - THEY have to meet YOUR terms. Send the validation letter and don't trust them as far as you can throw them - everything in writing!


    Don't get mad.....get even.

    Having your name, address, and phone number is NOT proof of debt.

    Sometimes they just use the phone book and look for any MARY STEWART...if
    they find 7 in "x" city...they might just "ding" all 7...

    CBS? Is that Credit Bureau Services of (wherever you live)? I deal with CBS of NH and have been feuding with them for quite sometime now. I just sent a "I caught you in a lie now fix it or get sued letter", They got it 12/14 and I gave them til 12/24 to respond or off to the courthouse I go! If it's the same compan y I'll keep you posted!

    Consumers recording the audio of telephone conversations is shunned because nobody is comfortable with the laws. But lenders do it all the time: "Some calls are recorded, for quality control."

    You can get all the equipment you need (tape recorder with audio input, and telephone adapter) at Radio Shack for under $30.

    Write to the collector and exercise yur rights under the FDCPA, for sure. But, call them back, too-- but resist the temptation to say something like, "You're on Candid Phone!" Just play it nice and cool, stay objective, and act how you would like the judge to hear you; anticipate how it will all look in court.

    If they're so dumb to say what they said, they'll probably blow it in other ways, too.

    I can record the phone call in my state, because I am a "PARTY TO THE CALL"...I am talking to somebody...BUT I can't record my next door neighbor calling to his work...because I am not a party to the call...

    KHM - Yes! It is the same company. It is Credit Bureau Systems of Owensboro - I live in Kentucky. I called the doctors offices that I owe and told them about my experience and both doctors offices said that they would have it removed after I pay it and would put it it writing and mail that to me today. They both said that they stopped using Credit Bureau Systems back in 1998 because of the unethical practices under which they operate. Next, I called the supervisor at this CBS and she apologized and told me that she woul "talk to her employee" and that she would personally be sure that these are removed as soon as the doctors offices contacted her. I also told her to put it in writing. I am going to send a letter to the BBB and let them know how I was treated. It may not change things, but at least there will be a complaint on file about the jerks.

    In some states it is actionable for one party to record a telephone conversation without the other party's consent with very hefty statutory damages.
