judgment question

    My sister has a judgment on her credit reports. It is a few years old. She was on unemployment and started working. She didn't report on time and they (the state of NJ) obtained a judgment against her.

    She wants to pay it off in the new year but she also wants to have it deleted. She owns a home and was thinking about refinancing. But the judgment would affect her mtg. rate.

    I have been reading some old posts and forwarding info. to here. From what I've read and the way I understand it.

    She should go to the court house, get a copy of the judgment and see if the dollar amounts were off or dispute that she was not served properly. Then file a motion to dismiss or have it vacated? Or does she file a motion to vacate after it is paid off? Or should she contact State of NJ and negotiate removal of the item if she pays it off?

    Any responses will be greatly appreciated, thank you.

    if she has judgments the mortage company will probably want them paid before refinancing her, unless it is included in a debt consolidation loan. yes, she should get a copy of her jdugement and check it against what it says on her credit report. She should have an atty or paralegal review it for service issues. She can dispute the debt with the cra's directly, they may not verify it and poof... it's off her reports, although she may still be liable for the debt. If she pays it and wants it off, she should investigate how to " vacate" the judgement. The court clerk can tell her when she goes to get a copy of her file. Also, she can ask the clerk if cra's send paperwork or verify electronically.... she will then have an idea how easy it will be for them to verify the judgment.
