duplicating an account a violation?

If the same account is listed on my CR's under two different company names, neither stating that the account was bought/sold/transferred or anything, could that be a violation of FCRA laws? I feel that this may confuse possible lenders into believing that these are two seperate accounts. Could I use this as a reason to file a lawsuit against the company?

Depends, the original creditor could list it ONCE along with any collection agency that had the debt. For example I had a charge off with a credit card company, they listed it along with 2 collection agencies. I contacted the FTC and was told that is OK.

Wouldn't the report have to state that the account was sold or transferred? If it does not say this, how would one know that these are not to seperate accounts? The two companies that list my account both have the same address, so I assume they are the same company.

On my Experian report, the account is listed as two seperate companies, one being Kay Jewelers and the other being Sterling Jewelers.

This is what is listed on my Equifax report.

    Kay Jewelers 297-800052XXXX
    INDIVIDUAL ACCOUNT 11/1999 03/2000 Revolving
    CHARGE-OFF $275 30 $0 12/2001
    Prior Paying History
    30 days past due 01 times; 60 days past due 01 times; 90 + days past due 04 times;
    PAID CHARGE OFF
    ACCOUNT CLOSED BY CREDIT GRANTOR

    --------------------------------------------------------------------------------

    Kay Jewelers 800052XXXX
    INDIVIDUAL ACCOUNT 12/1999 05/2000 Revolving
    CHARGE-OFF $283 $0 12/2001
    Prior Paying History

    PAID CHARGE OFF

As you can see, on this report it is listed twice as Kay Jewelers.

    Farmer-
Sterling IS Kay Jewelers, they are also Friedlanders Jewelers, and Beldens. I had a problem with them, they were quick to fix it, I can't find the number but call 411 and ask for Sterling Jewlers, I think they are located in Ohio. If I can find the letter I got from them I'll post the number.

I figured they were the same company. I just finished writing a letter threatening to file a complaint with the WTC and filing a lawsuit against them in small claims court for violations of the FCRA (reporting false information to credit bureaus that have negatively affected my creditworthiness) unless they remove all negative info from my report or delete the account.

Please let us know how the WTC handles your complaint! I know, I know, just a typo error just want to put a little humor in. LOL :)
