Bad Checks ...who owns them

    I remember reading that some credit card agreements state the debt can be sold, assigned etc. My question is, when a check is written that bounces and is turned over to a collection agency who owns the debt? I would think it is not hte collection agency, but the company/individual named on the face of the check, right? There is no acknowledgement, agreement or disclosure of an assignment, right? So...how do we go about fighting this one with a CA? Should we send the validation letter?

    I can't see how a validation letter would hurt. Although if they have the bounced check they would be able to validate.

    As far as assignment goes, the person on the face of the check can assign the check to anyone simply by endorsing it over to them on the back. I've done that before when I needed people to cash a check for me (with trusted family members only LOL).
