I am trying to get the rest of my negs off myself, since my Junum tragedy. I have sent validation letters to some credit cards that were bankruptcy accounts (is that legal, can you make them validate a bankruptcy account?) I sent the letters certified through that electronic thing with the USPS. I am trying to buy a house asap, so my question is, if they don't validate the debt, do you send your proof to the cra and you get to have it taken off? Or do you have to keep sending letters, ie the 30 and 60 day letters. My understanding is that it has to be validated for them to continue to report. Thanks in advance, I only have about 2 weeks left of the validation period, so I am very excited.
I would like to know as well, because I thought the validation letters were for 3rd party collectors. In other words if NCO is collecting for Citibank. I don't know if the creditor has to validate. I do have a letter I used to send the original creditor that someone sent me and it is a GOOD one. I have those out now to CCB and Orchard Bank, so I will see what transpires.
Terri, I'm at work right now but if you will drop me an email (it's enabled) so I won't forget I will email it to you when I get home. I don't keep any files on my computer at work because they are NOSY!!!
So what is the answer to the question? What happens if they do not validate in the 30 day time frame? Do we contact the CRA and they're OBLigated to take off the collection item?
The answer is, they are not obliged to take it off. What they are obliged to do is to consider all information you send them in regards to a dispute. This just happened to me, although it is with a collection agency. I sent the cra copies of the validation, estoppel and demand letters I sent to the ca, as well as copies of the certified mail green cards. I wrote up a letter, (which pbm has added to the letter list) and asked for removal. What they did was reinvestigate. That is not what I asked them to do. Anyway, the time for the dispute will be up on Friday. I'll post the results then.
I don't have the need for Estoppel letters since they don't contact me, or do I? What is the"demand" letter? Has anyone had anything removed when the ca refuses to validate/ignores you?
LKH, thanks for that info. Although, it does seem a bit discouraging. Just to clarify, if I send a validation letter to a creditor, and 30 days passes and let's even say 60 days passes with no verification. That means I don't really have that much ammo, since it's still up to the cra to take it off, depending on the mood and character of the CRA rep you happened to get in contact with by chance. However, does this mean that if I sue the Collections Agency, that I will most likely win due to the violation of the blah blah? Another scenario.. let's say that 30 days passes, and I am able to verify w/ the collections agency that they have no documentation of the debt. Does this mean that I can have it erased for SURE? Or is it STILL up to the CRA?
