This morining I was reading several post that stated we needed to check with our States Depts. to see if CA's are able to collect in our state. I found my State of Missouri site and went into my SOS info. where I entered the CA's name (Evergreen Professional Recoveries) query came back "No Records Found". Amount is $433.09 w/FCNB-Eddie Bauer/Spiegel/N. News. Ordered everything online last year before I lost my job. Is there another way I go about checking their ability to collect in my state or is the "No Records Found" with SOS office valid enough to send Evergreen a nice little letter saying "Back Off Before I Sue". I would be extremely overwhelmed with joy if that's another collection off my CR. All information would be greatly appreciated.
There should be a government office that you should be able to check with: Department of Banking · Consumer Credit Division this is what it is for the State of Connecticut
Can someone please HELP!! I have used both of the suggested sites below and cannot seem to find out where else I can search to see if Evergreen Professional Recoveries is licensed to collect in my state (St. Louis, MO.). According to the search I did with the SOS office they are not but I believe I need to make absolutely certain before I send them a letter to back off. Any feedback would be greatly appreciated. I would love to get that letter in the mail before weekend is over. Thank you to all and have a wonderful weekend!!!
why don't you call the secretary of state's office monday and ask a person. then if they're not listed ask them to send you a letter stating that they're not supposed to do business in your state. then ask who enforces it and ask that they ask the collection agency to cease business activities in your state until it does so legally. then send a validation letter to the collection agency along with a note stating that they're not even supposed to be doing business in your state (along with a letter by the secretary of state's letter to you). then, tell then you will not file the pending lawsuit if they not only cease efforts but also have the account erased not only with them but also with the original creditor... Or, sue them and get paid a minimum of 1k and pay them with that... or settle for 500 and a full and total deletion and erasing of the debt... you get the idea. start with the secretary of state's office and go from there. normally somebody in state govt governs collectors and enforces the laws... use them as well as your own efforts to make this go away forever.
