To sue or not to sue?

    Almost one year ago I was contacted by a collection agency while at work(had told them I was not allowed calls). They made several illegal statements to me ,such as threatening my tax return and wages, as well as insults (some nasty ones). I have one year to sue and that date is very close upon me. I have no real evidence except the notes I scribbled about the conversation. Now, they are several states away and I doubt that they would show up if I were to sue but can I sue with no more documentation than what I have? Like I said, I doubt they would show but wouldn't the judge want to see my evidence against them anyway?

    No, I don't think that you have a case. You have nothing to prove this. That is what is called hear say.

    Illini,

    I just sued a ca and won for similar behaior. They were also several states away. It was settled out of court.

    I would contact an attorney who specializes in this type of case and ask him/her if they think you have a case. I had no paperwork to prove anything. It all happened on the phone.
