Procedure letter questions

    Hi all!

    I sent a couple of procedure letters to cras and got back the name and address of the ca, or information telling me how they verify listings.

    I re-read the letter I sent (from here) and it does ask for this info.

    Has anyone had luck actually receiving the info they are looking for when using this letter?

    No. They will usually just send a letter duplicating the info already on your report, such as name of creditor, address of creditor and maybe a phone #.
    When I asked for procedure from TU for the bk 13 I filed but didn't go thru with, they sent me a letter that they verified it with US federal ct. and gave the address and a disconnected ph # for fed. ct. Only problem with that b.s. is that the bk ct. is located at a completely different address on a completely different street. I brought that to their attention, that there is no way they could have verified it, but they still refused to delete it.

    If they keep screwing around, report them to the BBB. This can be highly effective if the CRA is an affilliate or a smaller subsidary of one of the BIG three, but it does work on the big three once in a while... I filed a complaint with a local BBB, but you may need to file a complaint with the BBB located in the state of the violators...You can get it from www.bbb.org You can also file a complaint with the Attorney Generals office.. This can help at times, but not always...

    godaddyo, Have you had a lot of success getting the BBB to delete? If so which CRA's have you had the luck in deleting using the BBB? Charlie

    Well, it depends on how you look at it. They will just keep sending you stupid answers, with responses that give you the telephone # or address of the creditor/collector. They will never send you the name of the person who actually did the investigation or who they spoke to, unless you push things to the limit and get someone internally to handle your investigation besides one of their stupid clerks..

    The nice thing about asking for procedure is that you are letting them know that you realize that there is absolutely no way that they could have verified this debt and they better start doing their job..

    It also gives you good ammunition against them by leaving a great paper trail, just in case you need to sue them...

    Locally I was able to get a CBC/Equifax affilliate to assign the case to a supervisor who took care of everything over time and deleted all that wasnt verified. I am not sure if it will be as effective with the big three themselves, since it depends on wether or not they are a member in the area that you are filing the complaint and how they respond.
