Hi all, I'm looking for some advice on next steps in my journey. I sent my first disputes on 3 December, since then I've gone from 39 to 23 negatives. I have 9 disputes pending. Incidentally, my most success was with Equifax (8 of 11 negatives deleted), whom I sent the "worst" letters i.e. least professional, 6+ disputes per letter, duplicate disputes, etc. Every tradeline is settled and/or paid; the derogs are charge-offs (paid), collections (paid) and late pays. Re: what's getting verified, there are a few trends. Bank of America, Ford Motor, and Sterling have all verified each time, and they've verified quickly. For these three creditors, should I continue to dispute (some people seem to have had success with repeated disputing) and hope for the best, or should I start sending validation letters out? I've copied and printed out copies of Doc's litigious nutcase letter for paid accounts. Re: timing, I'd like to purchase a home within the next 3-6 months. Thanks as always! Missy
Have you considered sending the procedure letter? It will require them to tell you how they "verified" the account. By all means, continue to dispute...and congrats on getting the 16 negatives deleted! Small victories, don't forget about em GT
I found a real good procedure letter that isn't posted on the letters forum. it was originally posted by "Breeze". I don't know how to post the link to the thread, but if your email is enabled i can probably send it to you.
thanks for the advice and the words of support. I found the suggested procedure letter, and I think that I will use it. I haven't seen much on this board from people who have used this tactic. Have many people had success with this? Does it succeed in getting deletions or just in getting the CRA to re-investigate? Also, should I proceed with sending validation letter to the creditors at the same time? Missy
Missy Definately procede with validations to CA's at the same time. If the CA's verify with the CRA's before supplying you with validation they are in violation of the FCRA. Bobbi
Missy, Can you post or send me the procedure letter too? Thanks a bunch! andrewinpittsburgh@yahoo.com
Here's a copy of the letter that I found. I had cut and pasted it into word last night, and was unable to find it on the board just now, so I don't know who to credit, but thank you! Has anyone had success using this or a similar procedure letter? Thanks! Dear Credit Data Southwest: On June 5, 2001, you received a letter from me disputing certain items on my credit report. Your response, dated June 11, 2001, indicates that you verified one of the items as belonging to me. When in fact, it does not. Therefore, exercising my rights under the FCRA, please be advised that this letter is a formal request for the description of the procedures used to determine the accuracy and completeness of the disputed information, including business name, address and telephone number of any furnisher of information contacted in connection with this re-investigation, as well as the contacts, notes, or other items bearing my signature. Please be advised that I am aware that the creditors address on the credit report is not always the address that was used for verification. I, therefore request that you provide the exact address or telephone number used for verification. I am disappointed that you have failed to maintain reasonable procedures to ensure complete accuracy in the information, which you publish and insist you comply with federal law by providing the requested information within the 15 days allowed, or delete the item from my credit report. For your benefit, and as a gesture of my goodwill, I will restate the relevant dispute: â??WFNNB/LANE BRYANT- account #0000000â? As stated in my previous letter, the listed item is not accurate and is therefore, a very serious error in reporting. The Fair Credit Reporting Act requires that you report only 100% accurate information. Please delete this misleading information. I respectfully request that you provide the above requested information. If the requested information cannot be provided, the item must be deleted from my credit report as soon as possible. Sincerely, DID I MISS SOMETHING??? Suzy Q
