I've been going round with Verizon Wireless for some time. I have a few posts dedicated to my letters, etc., trying to get them to do the right thing with a pd chgoff. Their time runs out tomorrow and I haven't heard from them yet. I just got back from the local courthouse, I'll be filling out the forms and drafting my settlement letter tonight and filing on Thursday. The only bummer is my local court's max small claims suit is $3k. I have them on at least 5 violations. Hard inquiry with no permissable purpose, punitively re-aging my tradeline when I asked for validation, verifying the re-aged tradeline, etc. I was hoping to sue for $5k. I don't even want the money, I just want the tradeline gone, but if they just want to correct it and pay me $3k, I guess that'll have to do.
well, 3k is better than nuttin' ( provided you don't lose it in Las Vegas). You know that they will delete the account. I hope you are going to enjoy making them squirm for a change.
We'll see. They don't have to delete it. All they have to do is correct the date. But I will offer to drop the suit for deletion and some cash. If not, I'll win the money and continue to dispute it. When they screw up again, I'll sue'em again.
Thats not a bad idea, lbrown. But the consumers guide to municipal court they gave me, said I couldn't do that.
I'm so friggin happy! Looks like I won't have to file suit tomorrow! I had a "pre-settlement" offer on the table that expired today. I sent the following email this afternoon: Mr. X, I wanted to touch base with you one last time. I haven't heard from you and wanted to see if you were planning on responding to my prior email by todays end. I will be filing suit tomorrow in my local Municipal Court. Once I file suit, my settlement will not be as agreeable as the one you have on the table now.
