I'm thinking about mailing a check to one of my creditors that I defaulted with in 1999, and dating the check with a date in 1999 prior to the account charging off, and with the amount I owed at that time..... do you think they would process the payment and cash my check? If so, can I get a copy of that check (with the date on it and all) and dispute as paid in full prior to charge off? Would it work with a different account if it is already at the CA??? Just a thought..........
I thought there was a legal time limit on a check's validity? Something like 90 days after writing it? or is that an old-wives-tale?
Yes, when it is run through the banking system there will be a date on the back of the check also... so it wouldn't work--nice try.
TRUE....BUT!!! What if they had "lost" and then found check (as some companies have done) and just now processed for payment? Unless they make detailed notes on account that check was just received in mail....someone MAY cash....I can wait a month and pull copy of check and dispute that I mailed that payment a long time ago, a d I can't help if they just cashed (I KNOW! It's a STRETCH!)
Yes, but if you right checks regularly, it will be hard to prove when your "1999 check" is clearly in sequence with checks you wrote last week....
One possibility is that they would date stamp the received date, photocopy your check,return it to you as unproccesssable because of missdating,and update your account putting you back within the SOL and adding 7 years to your CRA reports.

I can always use one of my old checks ( I found one w/ previous address that I skipped over) well, how bout I give it a shot, and let you guys know if it worked? One never knows....
I used to be a bank teller. Most banks wont cash a check that is stale dated, or more than 6 months old. The reason is that the writer of the check has the right to assume that after 6 months, the check is no longer a negotiable instrument, and therefore the amount of the check can be reassumed into the balance he/she is keeping. It causes a big customer service problem that is avoided by not cashing old checks...
So the banks really look closely at the date a check is written? I didn't think they were that thorough...
Just called my bank and asked them, they said if it is attempting to be CASHED chances are it won't fly with the bank, HOWEVER if it is being DEPOSITED, 9 times out of ten it WILL get processed. I was seriously thinking of doing that with hubbys last CA, let me know if it works, I NEVER write checks in order.
Just remember.........they will want copies of the front AND back of the check to prove it was paid. Because otherwise anyone could fill out a whole checkbook and send copies.
LOL I just thought of a way to help your case.... Put the check in an envelope, then drop it in a puddle, step on it a few times, maybe even tear the corner...lol
