is there a SOL on a bad check?

    Good Morning!

    My friend, whose credit I am helping to clean up, just got a letter the other day from a collection agency regarding a recent bounced check. I suggested that he just go ahead and clear that, and he told me to read the second page. They dug up 2 checks he owed from 92, for a whopping 20.00. I found this to be unreal, and I think it is too late to collect on the 1992 ones, due to the SOL, but I am not sure. He lives in PA as I do. Anyone familiar with this?

    I remember a bunch of posts regarding this last year sometime.. I would suggets doing a search? This is when Anthony was posting here quite frequently..

    There is no sol on a criminal act

    A criminal don't have a SOL either

    there are sol on crimininal acts, especially if they are not felonies. you can call your local courthouse clerk and ask the question w/o giving any personal information and she/he should be able to answer.

    WRONG!!!! There are SOL on bad checks

    The FDCPA covers collection practices on bad checks,and therefore any SOL that applies in a State for suing would also apply to a bad check. The 7 & 1/2 year CRA limit would also apply. HOWEVER,any criminal charges would not be affected.
    By the way, the U.S. Senate, (Sen. Orrin Hatch) is trying to gut the FDCPA and remove returned check collection practices from it's coverage. This site his some interesting information.BE WARNED it has an ID program.
