Went to open savings account at credit union and was told to contact Telecheck. Contacted Telecheck as soon as I made it home and and the rep. told me that I had 3 checks from 1997. 1. Casino - $100.00 - Dated 2/2/97 (Telecheck Recovery Dept.) 2. Kinkos - $15.00 - Dated 2/11/97 (Telecheck Recovery Dept.) 3. Payday Loan - $220.00 - Dated 3/14/97 (Returned to original creditor) I asked if I could get this information in writing and she told me that they sent me notification in 1997 to my old address and that they would not send me anything else in writing. I explained to her that I had just been declined to open up an account and the slip of paper that the personal banker at the credit union stated "Under the FCRA, consumers have the right to a free copy of the consumer's information held in TeleCheck's files for a period of 60 days following an adverse action". You would not believe she told me she did not care what the FCRA said and that she was about to disconnect the call if I did not want to be transferred to the recording that states the address of where to send payment. I was blown away!!! Can someone please help me handle this.
I'm in the same position. Telecheck is claiming they've got 2 checks in their system that I know are not mine. I sent a letter to Telecheck almost a month ago to get my full report and haven't heard a thing. The numbers they gave me over the phone to contact regarding the checks have been disconnected. So without a paper report, I'm screwed.
Start your paper trail. Request in writing, certified, RRR, or other means with proof of delivery. They do fall under the FCRA.
I have requested twice in writing and I even sent self addressed stamped envelopes both times and nothing. Once in November and then again in January. But I did not send CRRR. So is that the next step, send a request CRRR? Where to? Should I send to a local office (I'm in MO) or to this address that I got from the credit union (Texas). Should I also send a copy of the slip I got from the credit union, it clearly states that they encourage consumers to write or call to obtain information in Telecheck's files.
Another thing I need to know, since 2 of the accounts are listed with telechecks recovery dept., is that the same as a CA? I understand that they can report for 7 years but can they still collect after the 5 years SOL are up which they are for both of them? Also, does telecheck have to abide by the same rules as the CA's in regards to validating?
I had sent a letter to the local affiliate office here in VA earlier this year just to get a copy of my report and make sure everything was accurate. I heard nothing back - not even instructions to contact another office. When I found out that there was stuff on the report, I sent the letter to the address on the piece of paper from my bank, which is their national office in Houston, TX.
I really just need an answer to the question, if the SOL is 5 years in Missouri does this apply to the 2 items on file with Telecheck dated 2/97 & 3/97? Please, Anybody.
Yes, I believe it does. Through my research, I have discovered that Telecheck and Chex Systems are held liable under the FDCRA. I would create a paper trail, then file a lawsuit in small claims. Good luck. In any event, I have heard that they will remove the negative in return for payment. Chex Systems leaves it on, whether or not you pay for a full five years. Even if you don't pay Telecheck, they will likely remove it after five years has passed. Calmest_LA P.S. Anyone feel free to correct me if I am wrong. I am still learning myself.
