This board is really great! Looking for some advice. Here's the scenario: 3 Chp 13's filed and dismissed (11/96,10/98,12/98) Accounts show charge-offs and late pays BIG judgement for $12,500 Ford Credit Repo for $10,500 Many of the accounts show incorrect dates, amounts, status, etc I don't want CCCS nor another BK. I'd like to negoitiate payment with some creditors that I know I can actually pay. For example, I have a charge-off from Cap1 for $3200. I 'd like to negotiate making some payments ($500 monthly) in exchange for better credit rating. However, there are a lot whose SOL will runout between now and May of 2003. The others I will dispute. So here's the questions: 1. When I dispute an item, do I just dispute a specific part of the item that is incorrect or do I dispute the entire item? Example: Previous mortgage shows status as WAGE EARNER PLAN, however the mortgage was never included in the chp 13 (the status is the only incorrect part of item). So do I dispute the status only or dispute the entire item as being incorrect? 2. Should I dispute any items whose SOL should terminate in the next 12 months? 3. Should I even bother with CAP1 to negotiate payments and credit rating? Based on the messages from the board, I see that there is a MR. Cooke that may be able to assist me. This account was opened in 1996 with a $5k limit and a charge off around 1999. P.S. In case you're all wondering why so many bk's. The 1st one (1996) was due to a layoff for 8 months. I found other employment but not as much money. The courts wouldn't reduce the payments to something I could live with (my daughter and I had to eat or we'd die). So the courts dismissed the case. The creditors came after me and I filed again (10/98). Some glitch happened with the attorney and he dismissed the 10/98 and refiled again on 12/98. Once again the payments were just so high I couldn't do it, so I dismissed that case on 10/2000. I refuse to file again. I'll just try to do what I can to pay those that need to be paid through negotiation. And those that I can get off by disputing hopefully will just go away. BTW TU=410 and Exp=569 Sonja
Actually, I would dispute the accounts that are falling off soon because creditor probably will not verify. I would dispute all public records, i am sure that they are bringing your scores way down. especially because it is really unusualt to have threebk13's any way so you may be in luck, especially with the older ones. yes, you probably could dispute with mr. cooke. i would do it in writing via planet feed back. i did this recently for my dh and he agreed to change from r9 to r4 i believe.
OK, I looked at Planetfeedback but I don't understand how to get to Mr Cooke from there. Can you give me the procedures?
just direct it to capital one. he will be the one to get it. so just write your letter to capital one credit cards . that' s it.
http://WWW.PLANETFEEDBACK.COM/homepage/0,2585,,00.html Fill in the "GREEN BOX QUESTIONS"...it will help you send a letter...(you will be walked through the letter writing)... MR COOKE might call you...8-5 NEW YORK time...
George, I didn't understand your last post in regards to complaint, compliment . Can you please clarify. I appreciate everyones response.
I guess if I would have just clicked the link all of my questions would have been answered. Thanks George and Uniondiva. BTW, when I tried to use pfb, the letter was going to be sent to the ceo Mr. Fairbank and not Mr. Cooke so I cancelled it. Also, is there any advice on my original questions?
The letter is addressed to the C.E.O....but MR COOKE is with the EXECUTIVE OFFICES and handles the the letters...
