Looking through my folders and green cards for CA's and CRA's that I have sent validation to in the month of February and I am overwhelmed with joy that every day for about the first couple of weeks in March I will be sending out Estoppel because to this date none have replied to validation. YEA!!!!!!!!!!!!! Look: Diversified Collection - Dental Bill $500 Validation Received 02/02 - response due tomorow :~) Consumer Collection - Emergency Room Bill $180 Validation Receiced 02/05 Associated Recovery - Cap1 $681 Validation Received 02/05 Evergreen Professional Recovery - FCNB-Eddie Bauer/Spiegel/N. News $433 Validation Received 02/05 **They have already violated because they sent me a letter (settlement offer) on the same day they received my validation. That's just for the first week or so in March but I have more responses due for the entire month of March. How likely are they to get their response back to me in due time?
The CA's are not REQUIRED to send you validation within 30 days, but they ARE required to cease all collection activity as well as mark "disputed by consumer" on your credit reports. Wait the FULL 30 days then send the estoppel.
Thank you KMH, well I guess I misread somewhere. So after the Estoppel which is next? And how long after Estoppel do you send the next? I need to refer to my notes, there is too much to learn here and I try and lock it all in my brain but I guess you can't remember everything :~) This board is better than school.
Send the estoppel, it outlines that you are allowing them an additional 15 days to respond or you will begin your lawsuit. Then after 15 days you can either file suit, or send them a copy of the FILLED out small claims paperwork giving them 10 more days before filing, sometimes this is all it takes, sometimes you HAVE to follow thru with the lawsuit. If they haven't marked the acct disputed on your credit reports I believe its a violation for EACH CRA they report on $3000.
