I know that this has been covered over & over again but I'm still not quite clear. Validation letters were sent out on 01-28-02 & 02-11-02. I have not received anything back from anyone. I called Equifax this morning to find out the status and 1 account has been verified apparently by email. Since they have verified without sending me proof, am I correct in stating that this is a violation? This particular company did not get the estoppel letter yet so should I send them one or state my intent to sue? Also, what was the answer to the question "does a phone bill constitute validation?" Thanks all.
Come on, guys, I know its the same old, same old but can at least one person take a stab at it? I would really appreciate it. Thanks.
Read the FCRA and the FDCPA in full. If they verify with the cra's during the validation period, it is considered continuing collection activity and as such is a violation. As far as the estoppel goes, you might combine an intent to sue with the estoppel, and give them so many days to comply with your requests or you will file a lawsuit. Don't know about the phone bill.
