Gulfstates/OSI do have them?

    O.K. I am in the process of estopple. Gulf states had derogs on my equifax. T.U. had them listed as O.S.I.. Now I checked my Equifax report today and
    the same Gulf States is listed 2 more times as O.S.I.
    and reported in 2 differrent months.

    I know its a violation but of what? Reaging? Can anyone give me the part of the FCRA/FDCPA that lists this behavior?

    I have this same problem, they keep relisting accounts, I have one 500 c/o on equifax 5 times!!! bastards.

    Have you already tried disputing with the CRA(s) as duplicate accounts?

    Did it back in November but then they re-appeared.
    this was before validation. Validation with O.S. I. seems to have triggered them into reporting.

    Its war now. I've had it. I'm going to find a way to sue them and get damages and deletes form them.

    So I will not dispute it with the C.R.A's.

    did you get notice of re-insertion, 5 days? with certification of the accuracy?

    Nope. This was before I was wise about FDCPA/FCRA.

    But if I dispute now and it goes off and re-appears (as It most likely will) then I should get that notice and if not I have another violation?

    (B) Requirements relating to reinsertion of previously deleted material.

    (i) Certification of accuracy of information. If any information is deleted from a consumer's file pursuant to subparagraph (A), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate.

    (ii) Notice to consumer. If any information that has been deleted from a consumer's file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency.

    (iii) Additional information. As part of, or in addition to, the notice under clause (ii), a consumer reporting agency shall provide to a consumer in writing not later than 5 business days after the date of the reinsertion

    (I) a statement that the disputed information has been reinserted;

    (II) the business name and address of any furnisher of information contacted and the telephone number of such furnisher, if reasonably available, or of any furnisher of information that contacted the consumer reporting agency, in connection with the reinsertion of such information; and

    (III) a notice that the consumer has the right to add a statement to the consumer's file disputing the accuracy or completeness of the disputed information.

    Thanks.

    I have to rer-ead the act. I seem to be missing violations that they are doing.

    Is anyone else having organization troubles with all this stuff?

    They still haven't responded to your validation? Instead they re-inserted with another name?

    They aren't supposed to continue collection activity until they provide validation. Contined reporting is considered collection activity.

    ka-ching, ka-ching, ka-ching, ka-ching, ka-ching.

    Summons the big dogs of the board, they will help you with gulf state specifically.

    Look for psychdoc's post near the end. That will help with the validation flow.

    Validate 1 (30 days)

    Validate 2 (60 days) You don't have to do this one; some have been allowing another 15 days here instead of the 30, builds more paper.

    Estoppel

    Send copies of everything to CRA's saying the debt hasn't been validated and therefore can't be reported.

    OR

    Can do an optional last letter before filing suit.

    Intent to Sue with Small Claims Court paperwork.

    It helps me to keep it all straight by reviewing the sample letters.

    I hate to be an idiot (OK...I admit it...it can be fun sometimes!) but what is estoppel? I have seen this several times and don't have a clear understanding of what it means.

    Send them two validation letters and if you get no response (which is highly likely), fax an intent to sue letter or a complaint you intend to file to the compliance department. You should get a call back in ohhhh...about twelve hours with a sugary sweet apology and an offer for them to send you a letter and fax a UDF to the CRAs...lol. Gulf State is annoying, but easy! Especially since when you try to validate they report you again under their OSI d/b/a...lol. May take a while after you get the agreement from Gulf State (I'm still waiting at three weeks, but that is Equifax's fault.)

    I too am battling GS and OSI on both me and dh accts....they are like the black plague, and hopefully we'll have the cure!!!!!!! They make me SICK! (I just shot off my first set of validation letters) Keep us posted on your outcome with them and DOCUMENT every little step!

    there must be something in the water...

    I am also doing the dance with Gulf State and OSI. I've gotten Gulf State deleted from Experian, but they somehow verified with EQ and updated to show 4 times 90+ days late with only 3 months reviewed. OSI showed up at the same time that Gulf State signed the green card. Round 2 is in the works...

    Ha Ha! I still am not sure exactly what it means but
    it works. You may want to look up the term in a good law dictionary for a better idea of its meaning and usage.

    I also had the same problem with them listing 3 times on the equifax and then when I sent for validation, the listed again for OSI on tha tone report. The other reports had the other OSI listing pop up too but not the duplicates. I guess they like to push people to see how far they will go.
