embarrassing question...

    Ok, heres the deal. My wife opened up a capital one card in my name without telling me by sending in one of the offers in the mail. it was charged off in Dec. of 2001. she made payments on it while it was open for a while using the online service and my checking account. I called and told them that I had just become aware of this account on my report but that it was not mine. They connected me to the Fraud Dept. The guy there said they will send me an affidavit to sign and then it will be taken off my credit report. My question is, what will they do next? He asked me if I knew who opened it and I said I did not know. I know the signatures will not match because I did not send it in.

    You could get your wfe into hot water with this. Unless that's your intent, I'd stay away from it.

    I believe they would be able to trace the charges back to your wife and she could possibly be prosecuted for fraud. Even though you guys are married, you still cannot sign each others name to a legal document unless you have given her permission.

    Here' where you'll hace a problem. You sign off that you have no knowledge of the account, look for them to ask why payments were coming from your bank account?

    I think you're stuck with this one. I'd leave it alone. Keepmine is right - they will question why payments were coming from your account. I also think it would be real easy for them to trace this back to your wife and at that point, she could have the authorities breathing down her neck.

    I would have to agree with everyone else on the board. Leave it be, your wife could get in alot of trouble. Since payments were being made out of your checking account and statements were sent to your address.

    On the other hand, I would make the wife your personal servant for the next month (or year...your preference).

    If the Credit Card Company finds out that the account was opened by your wife, and she used it, and even if your name is on it.. you will be held responsible....for the Debt.. This is called FAMILY Fraud.. The only recourse you have is to file charges against your wife... Also do not sign any affidavit stating that you know nothing about the debt.. Credit Card Companies Will find out that you are not telling the truth... Especially after it has already been Charged off..

    Pay the debt in full, and ask for it to be DELETED...if they REFUSE...try again later...

    YOU LOSE~SHE LOSES no matter what you do...
