WON by default!!!!!!

    I'm happy to report I won, well by default but still a win! I received a judgement against a CA to the tune of $5,107.50. Finally some GOOD news, after the past few weeks I really needed that!

    P.S. Estimated damage to fix the car is around $12,000.........

    Thanks everyone! I would not have had the courage or even the knowledge without all of you (especially Christi & LK)! So don't give up its worth it!!

    Yes, they are in another state. I had their regestered agent served (they were in FL). I also received a letter in the mail today from their attorney saying basically it was their mistake, they have returned the accounts to the original creditor and have requested all listings with the CRA's be removed.

    Now comes the fun part. You get to hire a collection agency to collect the debt for you.

    You should start calling them every couple of hours, then send them letters every day until it gets paid!!

    Don't forget to contact D&B so you can trash their credit if they don't pay.

    ~~WTG~~ Haven't heard from you in awhile. Didn't know the update on TU either. You need to keep me posted.......lol.

    That's great..what did you sue for $5K and that's fees too or what?

    I'm filing on 2 CA's very soon, hopefully this coming week, had to send one LAST letter to CMA. One is from Florida and I doubt they will appear. Even if they do I already have a letter from the CEO regarding their *mistake* on the 1st 4 accts I was dealing with them on. Those were removed and they just added 2 more (after my lawsuits). I think I will get their ass hands down. I got a letter from the Texas AG today stating they have tried to contact this company regarding my complaint numerous times and the company will NOT respond, so even more leverage for me to show the judge. I am going for $5K on them, will settle for $4500 and permanent deletion NOTHING less!!!

    Did you file in Small claims or Federal court?

    I've never sued anyone so I'm very apprehensive to file.

    Could you possibly lay out a timeline? When did you file and how long was it until the court date. Did they contact you before you got the letter from the atty?

    LOL-I love the suggestions!

    I plan on making this a NIGHTMARE for them - just as a little payback from us creditnetters! :eek:)

    Christi- I will definitely send you an update this weekend

    I filed in small claims in early March. I sent them an offer to settle for $2500 plus deletion and they never responded. The judge said I would have to wait for a copy of the judgement to be sent to me in the mail. The letter from their lawyer was dated the same day they were served.

    On a side note- I couldn't even count how many other cases where there involving cap 1 , ford, household, OSI, asset etc. however these where all for going after the people. The judge seemed a little *new* to my case (almost as if it was his first).

    Yes, he seemed surprised. I had to raise my right hand an swear in. Then he asked me again what I was suing about. I simply said they violated my rights under the FCRA and the FDCPA. He sat there and reread my complaint and looked interested by it. I had to provide proof that they had been served and he explained a judgement would be entered for the $5,000 plus the filing fees. I just sensed by his expressions this was not something he has come across very often.

    That's a shame.
    We should be suing them so much and so often that there is a constant stream of complaints flowing into every county court in every state.

    I will go along with what you say above.
    But it's about like dipping a bucket of water from the creek.My post was about how the trend needs to grow as you state above.
