Need Help - NOT Paranoid after all

    Remember my earlier post regarding my inability to access my last ScorePower report and purchase access to the revised Credit Watch...

    Well...this morning, I called EFX again to ask for results since I had not heard a thing from my inquiry last week.

    The lady EFX CSR eventually informed me that a
    "special department" was going to contact me regarding access. I replied back..."Do I have a fraud alert on my account". She stated "No" since it would immediately appear on her screen if an alert was posted. I asked if it was a "technical issue" and she replied that she wasn't aware of any. I continued with a few more questions trying to get to the root of the issue, but she just didn't have any more info. By matter of deduction, I am concluding it is because of my pending lawsuit (small claims) against EFX (Please don't ask me yet to divulge the content of my lawsuit...I will do so after my early May court date).

    Now my request to the EXPERTS on this board....

    I am searching various consumer rights websites for information on any violations of rights for banning me from service due to a pending lawsuit...especially, when I have already paid (Score Power) and can't get access to a purchased service.

    Do any such consumer right(s) exist? Can someone tell me how I can add such a violation (if any) to my pending lawsuit with EFX? Thanks.

    If you indeed did pay for the service and can't use it, that is additional damages for you and is additional information for the Judge.

    In most jurisdictions you can amend your complaint based upon "new evidence" or new findings. Call your small claims court and ask them the procedure.

    The worst case will be for you to withdraw your suit and refile it with the additional complaint.

    Remember you will be allowed to question the credit bureau representative. I'd suggest sending them a subpoena for ALL records relating to your score power service and the subsequent denial of service.

    At worst this will bolster your other claims by showing the judge a poor pattern of behavior.

    You may have to dig around to find it but I've found that the consumer affairs division of my state has some 'ready' answers to such things. Their # can usually be found in the blue pages of your phone book. Try giving them a call. They can also take your complaint at the same time.

    Just to follow up...

    Today (and for the past 2 days), I called EFX tech support group. They offered the same information regarding the "special department" handling my file.

    After eventually speaking to a phone CSR supervisor, he finally confirmed that my file was being handled by the SECURITY department. I knew it!!!!

    This is definitely linked to my pending lawsuit against EFX (5 counts of FCRA violations - details to follow after my early May court date).

    In any case, I PAID for a 4 report subscription to Score Power and can't even get that (I've already mentioned this earlier).

    I've found some good info on BBB sites. Any other reference sites?

    P.S. - Thanks to the earlier provided advice(s).

    If it helps you any, I have not been able to access Equifax for the last 7 days or so. I keep getting the server is too busy message. And I have never filed suit against Equifax.

    After 7 days of pulling reports, and getting that message. this morning in my email, I had the Equifax confirmation messages. When logging on, I now see a report for each day, I tried to access the system this week.

    When I tried to pull a report for today, once again I got the server is too busy message.

    So it appears that it is a legit problem and not anything against you.

    Thanks for your words of reassurance, but, as I mentioned, I called them today and finally discovered that even the phone CSRs can't get access to my file because it is being handled by their security department.

    I thought the same back on 4/3/02, when I called EFX for the first time to complain about non-access. I received those error messages before.
