CA's agreed to delete do I settle?

    I began requesting validation from CA's reporting to my credit reports in January. After my letters were all ignored, and I documented numerous FDCPA violations I took the following actions:

    1) I prepared a formal complaint to sue in U.S. District Court.

    2)I sent settlement offers to remove these accounts from my credit reports and pay $1000 for my damages, including a copy of my complaint which I intended to file if I did not receive a response.

    I was finally contacted by 2 of the CA accounts I was disputing and they agreed by phone to remove the trade line from my reports.

    Questions:

    1) Should I settle or pursue my damages?

    2) If I settle what documentation should I require that the CA provide to confirm that the tradeline is removed and will not be reported again in the Future?

    That's a personal decision.

    Since you're asking. . . .

    IF I HAD THE TIME, I'D TAKE EVERY ONE OF THEIR BEE-HINDS TO SMALL CLAIMS COURT (make it easier on me) AND I'D SUE TO WHATEVER LIMIT YOUR SMALL CLAIMS COURT WILL ALLOW! THEN, I WOULD TURN AROUND AND FILE A WRIT OF EXECUTION AND HAVE IT ATTACHED TO THEIR BANK ACCOUNT UNTIL THEY PAID ME WHAT THEY OWED, AND I WOULD CHARGE INTEREST ON IT UNTIL IT WAS PAID OFF!


    NO. . .I'M NOT BITTER AND I DON'T HOLD GRUDGES.

    Keller, I hope I never get on your bad side.

    As for going after damages, I agree. It's your personal decision. You got what you wanted, but you are intitled to the $1000 too in my opinion.

    In retrospect, that "DID" come across a little harsh, didn't it? Gosh, I bet you're envisioning me with a wart on my big 'ole nose, huh? :eek:)

    Today was NOT a good day for me to answer this question without prejudice. It looks like I will be filing on a CA sometime this week and perhaps one more before this is all over with.

    I WANNA BE LIKE JASON & PAT!

    I'll be there in 6 months. Mark my words. :eek:)

    It all depends where you live on how much you can sue for. It may get you $5000+. That would make it worth your time. Charlie

    You may also get a jerk of a justice of the peace and lose your case, which would mean no money and no deletions. If you think you have substantial valid proof to back you up, then maybe go for it. Personally, I would take the sure thing.
