CA stated filed for judjment HELP

    Trying to settel a cap 1 ca account. They are pressuring me to settel by the end of the month for 1087 (65% of 1600) but we have been making payments to the Cap 1 for the last three months and they have been cashing the checks and now the collection agency/attorney's office will not that the payments off the total and they told me they filed on the 3rd of April and next month it will not be and offer to settel. First they stated the are from an attonery's office but the someone eles in the company told me they were a collection agency. What to I do. Settle then file a law suite for misrepresentation. HELP I put her off until tomorrow. Need advise ASAP

    LB,

    Remember you owe them 1600 less any payments you've made. They are under no obligation to accept less.

    If the CA has filed a lawsuit, then you should have been served with it and given a court date. If those papers haven't been served on you, there is no lawsuit.

    If you truly want to settle a Cap 1 debt, I'd call the famous Mr. Cooke at the Capital One executive offices. Many others here have had excellent experiences with him.

    If you haven't already, I'd send them a validation letter.

    I tryed to get the address so I could send a validation letter then I called Mr. cooke. Had to leave a message. I have paid $300 on a 1400 debt that cap1 one said I owed. I will would be happy to pay 65% of 1100 which is $715.00. Just to get them off my back but I due want credit for the money I have been sending them each month. I know she is not telling the truth. Do I pay and file a law suite? I hope Mr. Cooke calls me back soon.
