I did the right thing and went after the CAs and OCs first - got UDFs from all of them asking for deletion. EQ refuses to acknowledge the UDF from the OC. I sent them a copy of what they were originally sent and they stated that "third party letter not accepted". I don't want to go to court, but it appears that I will have to. I like the idea of putting in a 100 word statement saying "Equifax has received a statement from the original creditor that the debt was erroneous and should be deleted along with a faxed request for immediate deletion but have chosen to ignore these requests from the creditor and have decided to keep reporting it although it is against Title 15 regarding the FCRA." They have to put that in, right? I will fluff the statement up a bit of course.
Maybe you could add to that statement "copy of said letter and UDF available to potential creditors upon request"...lol. I'm dealing with them over the same issue, so I feel your pain. L
in the fcra it states that during a reinvestigation the cra is supposed to consider all evidence submitted by the consumer (or something to that effect)... Why can't they just call the oc and confirm? lazy... I'd do a Demand letter with the violations outlined and sue them...
I faxed letters from ca's to equifax on 2 occassions and both times the item was deleted within 5 days. The fax # they gave me to use is 866-233-3777. Try that and see if it works.
They gave me the fax number of 888-518-6655, which I faxed to them on Friday. The guy that answered the phone was pretty nice, but he basically said he was a phone monkey and didn't do the actual investigations. I don't have the time to sue, I am too busy at work to do that, it would have to be a last ditch effort. I can afford to make calls here and there, but to take the time to actually go to court - definitely last ditch. But if necessary, of course I will.
Does anyone have a phone number to call an Equifax dispute in? Their online investigation will not let you enter inquiries...I want to call them and speak to a live person to see if I can get inquiries removed from Equifax. -Peace, Dave
