You guys have never failed......I want to sue a collection agency who appears as American Banco-denver on my Experian. They are out of Dnever Colorado, I live in California. They are no longer showing on the Colorado secratary of states web site as American Banco-Denver but as First Revenue Assurance LLC.

I want to sue them in small claims court here in California, but they have no agent in California. Can I sue them in small claims? I hear the term proper venue being mentioned all the time...How do I sue them? Do I have to take them to Superior Court?

Please advise regarding this matter. It is for an $189.00 collection. I have sent 2 validation letters plus I just sent the Estoppel letter. It has been over 60 days since I started the validaition correspondence

edward, Have you had ant response from the CA? Do you want to sue or want a deletion? Maybe, try and send all your documentation, and the lack of response from the CA, to the CRA's and you may get a deletion. I don't know about California, but I think that you can sue in small claims. It is your domicile not theirs. Charlie

    Charlie,

I have not yet received even a phone call from these people. No collection attempt besides the entry on my report. No validation attempts or correspondence. I sent the 2 validation letters and I just yesterday sent the estoppel letter. I will try sending that to the CRA.

Does sending documentation to the CRA work if you can show no attempt at validaion?

It all depends on the idiot that gets the letter. It's all a game of Russian roulette. Charlie
