i have a 30 day late from a year ago, and they are fighting me tooth and nail. They have validated twice with all 3 cra's and refuse to budge. I have called numerous times and they refuse to remove it from my credit reports. I sent them a certified letter over a month ago and have not responded. I can't believe it. When I told them on the phone that I would not give up, the supervisor just said "ok". That is always their response. They just don't care. When I sue them in a couple of weeks, I think they will begin to listen. I have the time and the filing fee is worth the trouble. It's not like I am asking for a big thing, just a 30 day late. I hope they go down hard. I have had nothing but trouble with them. They just dont care about the customer. Just needed to rant a little. Be prepared to fight them hard because it appears they don't give in easy.
Usually when you threaten to close your account they are desperate and will do anything to keep you as a customer. Have you tried this.
No...Providian WANTS you to close your accounts. I called when they raised my apr to the 29.9 on one of my cards and they must have asked me five or six times to close it. I explained to them that the errors on my credit report had been fixed and while other credit card companies were lowering my apr significantly...they wanted to bump it to 30% and they would do nothing for me. I called retention too...not just customer service. I asked them to pull a cr and reconsider and they wouldn't even do that. I guess once they decide...that's it. Sooo...my retaliation is to pay off their cards and sock drawer them...lol. Will try to get the fee waived and if they won't, they I may or may not cancel next year. Thing is...it may be worth the $59 a year because these are my oldest tradelines. Once my newer cards start to age, then I might can get rid of them without hurting my score. I hate Providian too. L
Don't count on it. Providian is unloading its customers, so if you call and threaten to close they will probably not fight it. But if you plan to close the account anyway- it is worth a try.
If you sent them a certified letter they had 30 days to investigate and respond. If they did not go sue them tomorrow. Perhaps name the CEO personally as well.
I am going to "test" them and see if the tough talk will get them to change the listing. I will put "Violation of the Fair Credit Reporting Act" and ask for 1,000 in damages.They have not marked the account as being under dispute, among other violations. The account has a balance of 450, so I figure they will just settle and remove the 30 day late. I want to see how far they will go with this.
Let us know how it works out. I tried to get 2 lates removed awhile back but I never even recieved a response. The account was closed by them last summer as they screwed up and I complained about it and threatened to sue. So I owe about 450 and have been paying it off as I go. Perhaps if I offer to settle for the amount next month, they will remove it from the reports. Thats all I really want. Maybe since they want to get rid of people they want to settle accounts badly. We will see.
I'll keep everyone updated. They act so nonchalantly on the phone, as if they could care less. I was nice to them on the phone, but now I am gonna wage a war. I have dealt with many cc companies, and these guys are the worse ones. I found Fleet, First USA and Citibank to be very receptive.
by all means do so, but why are you waiting a few weeks? Sue them tomorrow. ok monday. Name personal defendants so they have to show up (yeah, right). Its the same thing as the CRAs not investigating disputes. If people just sued IMMEDIATELY instead of merely threatening it behavior might change.
Ok... maybe I'm being blonde today... is the 30 day late an error? If so, wait out the 30 day demand letter you sent them, and on the 31st day sue. But do wait the 30 days...
Indeed, maybe. More importantly, who cares if the 30 day late is an error. There is ZERO financial incentive for PVN to report 30 day lates. Any lawsuit outside of Pleasanton costs money. If you think they violated the law, and judging from this thread alone, they regularly violate the law by failing to note an item is in dispute, then sue. Sue fast. Sue often. Sue many. Every lawsuit costs them money to defend. Right now it doesn't cost PVN anything to be a-holes. And it apparently violates the law with impunity. If you want behavior make that change.
