I'm in the process of trying to get some items validation with EQ, TU & EX. I've sent validation letters to the CA's and OC's with no response. I also disputed with the CRA and the items were verified. I've since sent off procedural requests letters to the 3 CRA's and the 15 days to respond has expired. What is my next step? Have I allowed enough time (+45 days from initial verification request) to pass in order to sue? I don't want damages....I would much prefer to get the items deleted. Questions: What State are you in? Do you have out of pocket money damages? I'm going to assume that yousent everything CRRR. In my state actual monetary damages are necessary, I'm planning on using the difference in my mortgage amount since first contacting them. CBJ
damages can be denial of credit, or higher interest rate based on inaccurate credit report. apply for something and get turned down... have a mortage broker do a letter for you... be able to demonstrate damages!
Well, I've been trying to get auto loans and I do have letters from potential lenders stating that I was turned down because of delinquent accounts being reported. Problem: I have to "REAL" charge-offs on my report as well. I doubt if the judge will believe me when I say the little $250.00 collection account caused me to be denied. I'll keep my letter though, just in case.
In Idaho this will not work . I would check with the code in your state. In her order, Judge Buchanan was very specific that the damages had to be out-of-pocket money damages. I don't think a denial of credit fits that category. CBJ
