Intent to sue results

    I recently have posted about my experience with collect america/cambece law firm. I made a settlement offer with them that had deletion of the account included. I fulfilled my obligation of payng them, this being some 5 months ago. I still have the tradeline reporting and I still get invoices billing me for an amount. Friday I sent a intent to sue letter throught the fax to collect america. They called three hours later. It was their attorney, so she said. She couldn't understand the problem so I spelled it out for her. She said that they had sent in a request for deletion in April, and went on further to tell me that it takes sometimes up to 90 days for equifax to remove it. I called her on it and asked for her to fax me a copy of the deletion sent to equifax. She said that it is done electronically and that she couldn't. Also she said that sometimes they send thousands of updates to the bureau and it takes a long time to download.(yeah right, months?) She then asked for me to send a invoice, she seemed to be really upset to the fact that I had been recieving these. Anyhow, I told her that after the conversation, I would be pulling my equifax. Well, it is still there, reporting unpaid balance. I've disputed twice with equifax and both times it is verified. Let me know if anyone of you have had similiar experiences. They seem to lie and dodge everything they can. I will file the lawsuit Friday if nothing has changed.

    Unfortunately, what she said about it taking up to 90 days is true. The only way I know to speed it up is to fax it directly to equifax at 1-866-233-3777. That should take about 5 days to get it removed. Call the ca tomorrow, and ask her to fax a UDF to equifax at that #.

    Funny I called on Thursday regarding a CBCS deletion and it was deleted off experian the next day. I don't buy that up to 90 days BS plus if he disputed it twice already and they continue to verify it as accurate, thats illegal as hell.

    Screw it and sue them, they don't care about your economic welfare, why should you care about theirs?

    It was deleted because you initiated it. If left to run the normal course, it could take up to 90 days. It isn't a priority. If the ca sent via UDF, then equifax says it could take 30 - 60 days. I'm not making the time limits up, I was told by equifax.

    LKH I am not saying what you are saying is untrue, but if they send in a UDF to the CRA then why didn't he get a copy of it? All he then has to do is mail it to CRA and ask why this hasn't been taken care of? I believe the collection agency is lying.

    If they sent via UDF, then they should be able to produce it. But, he said they claimed to have reported via tape. I agree that if they sent him a copy of the UDF all he would need to do is mail/fax it to them. That's why I suggested he call the ca in the morning and ask them to fax a UDF to equifax, and then fax a copy to him. Then, he can also fax a copy of the UDF and have it removed in a few days. Hopefully. If, after requesting this it isn't removed and/or they refuse to do this, then I would consider a lawsuit. I believe it always better to try to work it out before suing. A lot of times it can't be worked out and a lawsuit is necessary, but if it can be settled without court, it is easier on everybody.

    And yes, I did sue my local Experian affilitate, but it was only after months of trying to resolve it.

    They do update via tape, but they can also issue a hard copy of the UDF and fax it in. It does take 60-90 days for the CRA to update, unfortunately. I agree with LKH...its faster if you fax in a copy of of the UDF. It can also be speeded up by disputing it again with the CRA...unfortunately, this does not always work since they sometimes verify before all of the records update. I've had this problem myself.
