I am going to call the CA that is handling my defaulted student loan today. Is there anything I should know before calling them? There said they are going to want financial information, including employer info as well as references, etc.. Do you think they will contact these people if I adhere to repayment schedule? Is there some information I should not give them? I have also heard of people simply mailing in payments to the CA and after 12 months asking for rehab. Is this the better way to go? contact dept of education regarding your defaulted student loans to get accurate information on the status including balance. ca may want you to consolidate (they get fee off the top) so they may propose payments that you do not agree with, i would try dept of education before calling ca. have you validated these loan amounts, fees any previous payments?
I have never made payments on this loan. No, I haven't validated the amount. The CA said by not responding to a letter in March (don't remember ever getting a letter) within 30 days, that I did validate the loan. Is this correct?
No.... Here is the section of FDCPA that says you do NOT lose your right to validation just because you did not respond to their letter within the first 30 days. § 809. Validation of debts [15 USC 1692g] (c) The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer. To me, that's the best reason for having the Certified Return Receipt mail or proof of fax or whatever...because then if it goes to court, YOU have a papertrail of correspondence, and THEY don't.
