file segregation

    Has anyone had success with getting a new credit file?
    New question....I have a judgement on TU and same creditor on Exp as collection. If I dispute do I run the risk of it being judgement on both?

    file segregation is illegal.

    i would dispute the judgement as " not mine' and see what happens". As for the collection.... who is it listed with.. if it is not a public record, i doubt it will be added as one, the worst is that the collection will be verified.

    Seems to me that if it's not a judgement then TU is reporting it wrong and verification is needed. Since it's wrong...

    OR

    Seems to me that if it's not a collection but rather a judgement, then Exp is reporting it wrong and verification is needed. Since it's reporting wrong..

    OR

    If neither of them are reporting correctly then a simple lawsuit would be in order.

    Decisions..Decisions..Decisions.. Alas after re-reading I'm guessing it is a judgement. In this case, how old is the debt? Send an estopple and request verification directly from TU/EXP and the creditor. If it's old, they probably won't verify. If it hasn't been updated in a while I bet the judgement might have been forgotten if it's been a while.

    Thanks for the info. It is a judgement because I saw it at the court. It was filed in 1987 and renewed in 1997. I'm in CA and it's good for 10 years. On the EXP it's the collection agency reporting it as a collection. It is due to come off in 2 years. Just concerned waking up the collection agency on EXP.

    In any public record on your report, be it a judgment or BK, the underlying debt is usually reported. In the case of Bk, it is reported as discharged in BK, in the case of judgments, even after a judgment is filed the account may still be an active collection entry by either the party that filed the judgment, or whomever they sold it to. Unlike BK, the debt is still collectible.

    After re-reading your post, is the file# of the renewal the same as the original? If so, then both the judgment and CERTAINLY the "collection" account are over 3 years past SOL for your reports.

    Yes, the file # is the same. Are you claiming that a new file # should have been filed in order for the judgement to be good for another 10 years? That would be awesome if they messed up.

    Hi Uniondiva,


    Sorry for changing this thread. I don't know if you remember me, but we talked some time ago about a Student Loan Dillema I was going through with a school that closed (Masters Institute)

    Well STRF (student tuition relief fund) wasn't much help to me - the woman keeps telling me how messed up all the thousands of records are, and how it will take months if at all even possible to recover any of my records from that stupid defunct school.

    Now just yesterday I got a call from the collection division of California Student Aid telling me they are about to garnish my wages....YIKES!!!!!

    So today I called Dept of Education (defaulted school loan dept) and explained to them how the school basically robbed me and that the last validation I requested came up with two altered promisary notes. The guy seemed nice and said they will get to the bottom of this, but he couldn't tell me for sure if the garnishment will be stopped or not.

    .............THIS IS A NIGHTMARE THAT WILL NOT GO AWAY!!!
