Question about CA

    I have a CA reporting a CO. The CO was originally for $365 but they are trying to collect $553. I have sent letters to them (I have a file full) requesting validation (full validation) and the only thing they send me is a photocopy of the last bill but no breakdown of where the other fees are coming from.

    I have been fighting these people since November of last year. In addition, it's not listed as in dispute.

    I'm formulating another letter now (even though I've already emailed the intent to sue letter) and including the info from the California case that was posted today where the FTC sued and won against a CA for NOT listing an account as in dispute.

    Is my only option at this point, to sue? This is the last negative on my EQ file and it would be GRAND if I could get rid of them (they aren't on my other two - I disputed and it came off...funny EQ keeps "checking").

    If you can get the contact information for their complaince or legal department and start a dialog with them, you might have more luck.

    Also, I've noticed that drafting a complaint and faxing it to them saying it will be filed within 48 hours or 3 days or whatever if there is no response has also worked.

    Of course when it doesn't, be prepared to sue. I think the idle threats they hear all the time are what make it necessary for the rest of us to actually sue in order to get results. They must hear that threat with every other phone call.

    My guess is that EQ is getting verification via tape or even making it up, since you get NO response whatsoever through the validation process...makes me think they are not responding to EQ either...but EQ simply says "verified".

    Have you tried to send a procedural request to Equifax? To get a line on who, what, when, and how the CA is verifying.

    I agree with what Whyspers wrote...they must get idle threats to sue all the time. If you can get in touch with their compliance department you might be able to strike up a dialog, but validation and simple disputing are probably a waste of time seeing as how you have sent so many already.
