letter from 1stUSA...check it out

    First off I disputed 4 charge offs and got 2 deleted. You all gave me good info. BTW.. one that validated was Nextcard.

    Got a letter from 1st USA that states "After researching your dispute, inlcuding review of our records related to the account, we are unable to clearly determine your responsibility for the account.
    We informed the CRA that the account should be reported as disputed on your credit file pending a further investigation"

    It then goes on to say if Iwant to continue to dispute the account I need to fill out the enclosed affidavit stating that I never applied for an account.

    Question: Should I contact the CRA with this info or 1st USA demanding deletion? What would happen if I fill out the affidavit? Are they setting a trap to bust me?

    TRAP~~~RED FLAG!!!

    If they can't PROVE your responsibility for the account...they MUST delete it!!!

    Don't send them ANYTHING. It's their responsibility to validate the account; not yours.

    I'd fax this letter to the CRAs and demand that you want the account DELETED since the OC has admitted in writing that they can't prove it's yours.

    A "HARD" DELETE...so they can't put it back on...(when they say you didn't provide us with the needed additional information...so we ASSUMED you wanted us to DROP the research so we put the account back on your report as it was)...

    Bigmon,

    Way to go - they just admitted with that letter they cannot validate that account. Just fax that off to the CRA's and I'm sure they will have to delete.

    Thanks for the input. Do I need to have a fancy cover letter with it or just write on the 1st USA letter?

    Does anyone have the best fax #'s to use?

    I would NOT write on their letter...I would write my own letter and use their letter as page 2 (ATTACHMENT)...

    FAX #...I have no idea if it works and if it is the correct department...
