What do you make of this?

    Back in March I sent a validation to First National Bank Brookings. I was not expecting them to validate but I did hope that they would not mark the account in dispute. Well they didn't so I do have them on that vioaltion. But what they did do was remove the charge-off and gave me R1 rating but left all the lates on there with some ridiculous number like 20+90 days late. I don't even think that's possible. Anyway they sold the account and the same account is showing on my report under the Credit Store with an 05 rating and a balance of 1370. I also sent a validation to the credit store which they are required to respond to but they ignored it and did not mark the account in dispute. I need a strategy to knock both of these out ASAP!

    Threaten Credit Store with lawsuit. Quote the section of FDCPA that states they must update to show in dispute.

    I battled with them for a few weeks before crushing them

    Did you mean to say 20x90 days late?? I cannot stop laughing-I know it is really late here on the east coast but oh my gosh. No I do not think it is possible to have something late that exceeds the SOL. LOLLOLLOLLOL

    it reads 21 times 90+ days late.

    They think if they can phrase it differently we will just accept it. They can think again.

    Hey, my Sears and Filenes both said 30-32 times 90+ days late. One is gone now though, and the other will soon follow!!

    I paid my cc off and closed it. they still have my lates listed. I sent them nutcase and son of a nutcase... i jsut asked them to send me proof of the accuracy of the reporting... they have not listed the item as in dispute. when i asked for validation they sent me a copy of a signature for a new account in 12/2001 not the original account from 99.

    I am going to file a complaint with the SD banking commission and send intent to sue soon...

    Wow, you still working with this one. Well I'm sure by now you got a pretty good list of violations built against them, They were pretty stubborn with me and at one point did put the account in dispute when I sent my first settlement letter for deletion prior to legal action. The letter just merily stated the violations they commited and put a settlement phrase wanting deletion befor taking legal action. That pretty much got there attention as it was responded by there senior consel this time. They placed the account in dispute thinking that was enough for them but what helped me was prior to sending this settlement letter they sent me a letter stating they have no documentation for validating the debt, and merily stated they purchased a portfolio which contained my account in it. So it took a second settlement letter stating the validity of the account befor taking legal action, well this is where they caved and and didn't see it was worth there time togo to court with me. Hope you recieved something from them stating they can't validate the origin of this account when you sent your first val letter this was a useful piece of evidence to use against them :) Hope this made sense,Gooluck
