Deleted item has returned

    Hello everyone,

    I'm still a newbie to all this credit stuff, but I have a serious question. I had an account that was deleted from my EQ file on April 10, 2002 and today when my file was pulled the deleted account was there. Is there anything that I can do about this situation? Can any legal action be taken?

    Why was it previously deleted? Was it because you disputed it? If so, then the cra needs to notify you within 5 days of it being reinserted. If it was removed for any reason other than you disputing it, I don't think you have any recourse unless the date of last activity is more than 7 years ago.

    If it was disputed, deleted and now reinserted, it may be listed with a different acct #, in which case they will tell you it is a different acct and not subject to the 5 day notification. If it is the same, I would call the cra in the morning and demand that they remove it again.

    Does the 5 day notification rule apply even when a POSITIVE acct is reinserted even though it was deleted from the file through a dispute?

    the law doesn't specify negative or positive, so yes, it would apply to positive account.. but why would you complain about a positive account being reinserted?

    I was just curious. I thought I had read on TU's disclaimer page that the notification applied to negative information only and I thought that their statement wasn't correct from my reading of the law. Just wanted to check.

    What if the positive account was not yours? Some may argue that it helped their report look better and would let it stay, but what if the real borrower defaulted?
