Credit reports were clean and this popped back up... Really ticks me off as this account REALLY IS NOT OURS. I am writing this letter in regards to a collection listed with the ********* for a Detroit Edison paid collection that does not belong to me. When my wife spoke to you on August 29, 2002 you informed her that you had no other information on this account other then that it was a paid collection. We have contacted Detroit Edison and they also do not have this account information listed with my Social Security number. Because our certified letter sent June 15th 2002 was refused, I have come to the conclusion that you are not willing to validate this debt according to my rights under the FCRA. For the record I will state again that this is not my debt, as I have never lived in ******** ********. There is obviously a mix up here as you also claimed I have a father named Michael listed with my social security number which again is not true. I ask that this information be IMMEDIATELY removed from my credit reports. Because this is a serious error on your behalf I was told at a automobile dealership that I do not qualify for 0% financing. This is the only negative notation on my report and it is not acceptable because this debt was not incurred by me. I have spoken to a attorney that specializes in consumer rights and the FCRA and he is very willing to take our case in the event that this error is not immediately corrected. Again, I will be filing a lawsuit for your violation of the FCRA plus actual damages caused by this error if you do not fix this error within 5 business days.
At the end of the letter you should state that you expect proof of their request for removal to be faxed or mailed to you. You want a copy of the UDF as well as a letter stating this was a mistake and that the request for removal has been sent to the cra. Other than that, go ahead.
One other thing, if you are sending this to a ca, then where you talk about your rights, include the FDCPA as well as the FCRA. If you are sending this to the oc, then change the word validate to verify, as oc's are not liable under the FDCPA.
ohnostuck, How about the state law that you live in? Do they have tougher laws than the FDCPA or FCRA? That also could help you. How's the house deal coming? Charlie
Charlie, Things are going good with the house. We have been approved for our loan and I am just waiting to see what the cost of pile foundation will run us if we choose the property we found. It is an AWESOME deal. Land here is very expensive. I found a one acre parcel with private 220' lake frontage attached to the deed across the street for less then 1/4 of what it was appraised for (by someone we hired ourself). I will let you know when I hear more.
