Help with filing lawsuits

    Can someone help me with filing a lawsuit?

    Here is the info:
    TRUTH first, their story from letter to BBB in ()
    Account still on my cr as of last night/

    1. Requested validation (sent validation info)
    2. Called my home, no one home, name and # on caller ID (called Terri, she said she was waiting for more info)
    3. Sent collection letter.(sent letter)
    4. Researched myself and found out it was a medical bill which should have been covered by a hospital program years ago, made calls, sent letters, got it handled. (OC informed us debt paid. Removed from cra.)
    5. Faxed Intent To Sue to ca, and online dispute to BBB. Rec'd letter the following day with UDF form attached.(rec'd fax, deleted.) August 3.

    Account still on cr last night, Sept. 11.

    I THINK I can sue for:
    2 attempts at collection w/o val: phone call and collection notice.
    Not removing even though they said they did 2 x (lol)? I really think I have to sue the cra for this.

    Am I correct?

    Please? Anyone? I am about to lose it with trying to figure out all the details for all my credit problems. I can't seem to remember everything I read any more.

    (Combination of middle age and stress from waaaay too much going on in my life right now)

    I am going to have to do this several times, and I am afraid of doing it incorrectly. My husband concerned we will mess it up and hurt instead of help ourselves.

    TIA for any advice.

    Have you tried sending the UDF to the CRA's?

    I am not an expert - but have you sent an "intent to sue" letter to the CA with a copy of the UDF (if it's from the original creditor?) That might get them to take it off.

    Wait for others to give advice here too - I'm certainly not an expert!

    You can sue, based on those violations, but you have to prove actual damages due to the listing/violation.

    Hi Terri,

    Fax your UDF to someone at the CRA. Be sure to talk to them first to see to whom it should be sent.

    Enlisting the help of a conscientious person at the CRA (if you can find one) is PRICELESS in this case.

    Sounds like your delimna is with the CRA not the Data Furnisher. They've at least made their half hearted attempt to get it removed. You can handle the rest.

    Just a little diligent follow-up should resolve.

    Terri, apparently the CRA's can take 60-90 days to update based on a UDF. However, if you dispute, that reduces the time to 30 days. Doesn't make much sense, I know, but the best bet would be what a previous poster suggested and fax the UDF and tell them based on the attached UDF from so and so, please immediately delete. I've had success with doing this varying from three days to a week for the deletion to take place.
