Hi Everyone, Here's today drama: I have a paid charge-off ($402.00) with Providian Bank, date opened 03/97, (this is scheduled to come off 05/2004). I sent Providian a nutcase letter on 08/06/02 (sent CRRR). I receive a letter from Lydia Kam, Executive Office Specialist, with Providian stating that "Unfortunately, we are unable to retrieve the account information that you provided to us". Then it goes on by saying to contact them in order to hopefully resolve the situation. Providian is reported on all 3 reports as paid charge off. I have provided them with the account number listed on my reports, as well as the credit card number that referenced my account when it was active. My questions are: -Do I contact them via letter CRRR and try to get them to change the CO to paid as agreed? -Do I dispute this with the CRA's? I live in MD, so the SOL is 3 years I think. ANY help on this is GREATLY appreciated ... UNLV34
Have you thought about sending that letter to the CRA's? Just a thought, might get it taken care of faster.
Hey TNobles, I am still a newbie and I thought sending a nutcase letter to Providian (since its paid and the account is old) would suffice. If I send the nutcase to all 3 CB, would they just try to verify the debt?
i don't think that they were referring to the nutcase, but the letter from providian,which basically states they are unable to pull your records and verify your account information. The theory being that this might be enough for cra's to delete.

yeah, in your letter to TU and EX and EQ....be like..."see here, even the OC(Providian) said the account alleged to be mine (acct#) doesn't exist. I request this account, which doesn't and never existed be deleted from credit file." Then inlcude a copy of the letter Providian sent you (which hopefully is on letter head and references the non-existent account). as proof.
Do you have a contact address for her? Phone# Or fax? I need to do a payment in exchange for removal or some such letter to them and I need a person to contact.

How old is your account, I have one with them that when I called to see if they had any info, it came right up.
Hi Kbanger, My account was opened 03/97. I paid this charge off awhile ago, but I responded to a basic collection letter back then. That was before I new anything about this board and the family of supporters on CN. I sent a nutcase letter since all 3 reports show Pd charge-off. I was surprised they couldn't find the account since I supplied account # of the credit card, as well as the account that is listed on all 3. Well, I am disputing with all 3 today with a copy of the letter from Providian stating they were unable to locate my account. Hopefully, all 3 will delete based on that or it will give Ms. Kam 30 days to find it UNLV34
I'd fax Lydia at Providian (and then later mail it certified rr) ... one that states.. I thank you for your honesty regarding this account. I am a bit perplexed that Providian has not only initially reported but also "verified" this account to the credit bureaus without any information or documentation regarding this account. As I am sure you are aware, reporting and then verifying an account to the credit bureaus that Providian can not substantiate is a clear violation of the Fair Credit Reporting Act. Regardless, since Providian has now admitted that they are unable to verify any information that pertains to this account, I am certain you are already beginning the process of removing the account in full from Equifax, TRW, and TU. Please send me written verification that you are removing the trade line #..... in full, and I will not pursue other legal remedies. I will anticipate a confirmation of deletion letter from you by October 15, 2002, as I am certain Providian will want to comply with the Fair Credit Reporting Act as expeditiously as possible. Please understand that this letter also serves as a demand letter for $1,000 for the Fair Credit Reporting Act violations. If I must pursue this in a court of law, I will also request actual damages, statutory damages, punitive damages, plus any expenses, costs, and attorney fees. Please be aware that I am emotionally willing and financially able to pursue this matter in a court of law. If I do not hear from you in writing by October 15, 2002, I will begin proceedings against Providian including but not limited to: 1. Filing a lawsuit for violation of the Fair Credit Reporting Act in US Distict Court 2. Filing a complaint with the state Attorney General's office 3. Filing an FTC complaint 4. Filing a BBB complaint and any other appropriate actions my counsel may deem appropriate. But in the spirit of good will, I am giving Providian one last chance to delete this mistake in full and I will settle for just full deletions of this trade line. This offer is good until October 15, 2002. After that date, if this matter is not settled, I will pursue it to the full extent the law allows. Thank you in advance for now taking care of this matter. Hi Marie, Wow!!! This is a great letter. I will follow your advice to the letter. Perfectly written. I am going to send it CRRR tomorrow and fax this letter on Monday. HI Marie, I have sent the letter a month ago to Providian attn: Lydia Kam (sent CRRR). It was picked up by someone else at Providian. I also disputed with all CRA's. I received a reply from Providian with the same EXACT LETTER that was sent from Lydia Kam. All 3 CRA verified the debt on my CR, so what can I do now to get this removed since this charge off is paid? I am using CHOD to dispute 2 BK13, a tax lien, a judgement and 5 yr old auto repo. Any help is greatly appreciated.

The letter you sent did notify them of your intent to file a lawsuit. You should file the lawsuit. You will get their attention.
