Has anyone ever considered a class action lawsuit against Equifax for their Credit Watch service? I had a conversation with someone at their office yesterday explaining how my file continues to get split in two because I am accessing my credit on a regular basis. She proceeded to explain to me that by my doing this, as most of you who have experienced this knows, your file gets too big and the system will split it. "Is there a reason that you are getting your file so much, Msdrmgirl6?" "Yes, because I paid for it and on the website it says that I can. To my understanding and according to Websters, UNLIMITED means having no limits, bounds or qualifications. That doesn't mean I can access it every other week, once a month, once every two months, it means WHENEVER. And if thats the case", I explained," maybe they should change the UNLIMITED to LIMITED credit access." You know why they won't? Because that wouldn't sell their service now would it? And the fact that they keep fixing mine proves that it is a flawed system. So on any given day, if your file is pulled by you, you could be getting an incomplete file thinking that this is what the creditor is seeing, when in fact, the creditors' system will pull up both files and you get an inquiry and declined for the credit. I going to talk with an attorney and get an opinion. I was just wondering if anyone else had ever considered filing suit.

    Just venting.......

What are your damages? What would your cause of action be?

Hey Whyspers! Well for one thing, my damages would be that files that were "supposed" to be deleted were showing up on the second file so when the credit was pulled, the potential creditor saw incorrect credit information. So about 2 days ago, I was denied credit because an account that had been deleted no more that 3 times showed up again on the second file. On my end, I saw that it was gone. I asked the lady at Equifax why these files would keep showing up and she said that when files are removed, there is a code that is supposed to be put on it to keep it from recurring and the first three times the file was corrected, that hadn't happened. I have letters & copies of reports where the information was removed. The first time it happened, they did the 30 day investigation again and everything was removed, again. I didn't think I should have been subjected to another 30 day investigation but I let them do it. Not more than 1 month later, some of those same files showed up again. And I have been calling Equifax almost every week. Well, I had about had it when it was made to seem that this was all my fault for accessing my credit file "too much". And just the sheer aggravation of it all is damaging in itself.

I have a file with equifax that is split also. one report now shows all but one of my positive lines and 3 negs. The other report has one positive line and one neg from 96 and all 3 from the other report.

Im curious as to what kinda score or what exact reports the people are pulling when I apply for credit. Getting that info from them is like getting the formula for fico scoring.

If equifax cant afford or get a program that will store and report a persons info REGARDLESS of its size maybe they need to stop reporting people info and paying damages for people who may have had a fair chance at credit if their file would have been reported correctly.
