I had a judgement from 1991 and now they put a restriction on my bank for 2 times the amount! Their attorney said the judgement is good for 20 years but I live in NY and I thought it was for only 10 years! Please help!
Tina, Please explain your situation In more detail so someone here can advise you on your best option in this situation. Honestly I cannot think of a any judgement that is good for 10 years unless we are talking about the IRS. ANYONE ELSE??? -Sal
It is my understanding that a judgment in New York is good for five years, but if you re-file it every five years, it is good for as long as you keep re-filing. I was asking one of my bosses about this in passing as my hubby has a small claims judgment against someone that we have never done anything with and it expires next year (five years) if we don't do something soon. I may be wrong as the details of our discussion are a bit fuzzy...but that's what I got from the conversation. L
Sorry, but can't edit. I was wrong. I just did a google search and New York judgments do expire in 20 years, but are renewable if you do so prior to the date they expire. L
I was served in 1991 when I was in college. apparently the collection agency is an attorney and they somehow found out my bank account and filed for a restriction on September 26,2202. A full 11 years after the judgement was filed. They said the judgement was good for 20 years. I do not know what else to say except the facts
I can't speak for NY state law, but in most states judgements can be renewed. In California, a judgement can be renewed over and over for almost 40 years. That is why judgements are very bad things and should be taken seriously.
