After reading this board for a while, I decided to start working on my Charged Off. My very first try, I sent a request for a proof on the amount the bank said I owned. In response, they sent me a stack of account statements, activities and said it's good enough to proof?... Is it actually good enough to proof, provided that the account is mine? Thanks!
If there was also a copy of the contract/agreement with your signature, then I'd say it is good validation. How old is this acct? And if it is fairly new, why did you do this? Have you read the faq's at the top of the threads? If not, do so. Then read the FDCPA and the FCRA. And finally, before you do something next time and your not sure what you are doing, post the details and ask. Also, are you aware that banks, as an original creditor, are not liable under the FDCPA and therefore do not have to validate. The fact that they did is surprising, but it sounds like they proved their case.
Did you try and dispute the account via the CRA's first? Did the bank send the chargeoff to a CA? Charlie
I wished I knew this board long before. Anyway, I paid CA in full; eventhough, I was still not sure how could it have happened. I did not use this checking account for 1 year, while I was out of state. Now I sent a request for verification. I then learned the amt that the said I owed is from an overdraft protection loan. They sent me a stack of account statements. Other than that they did not send me anything that has my signature on it.
It's still fairly new, or, not that old. You said it is paid? Well, have you disputed it with the cra's? Since it is paid, they may not bother verifying. As for the validation, it sounds to me like they did a pretty good job of validating. I would try disputing it with the cra's first. If that fails, you could send a letter to the ca asking for them to delete it.
