    Hello All.

My name is Chris. I am a 23 yr old business owner hailing from Hampton Roads Virginia. My wife and I are looking to purchase a house by the end of next year and I need to freshen up my credit so to speak.
Her credit is perfect, but not very lengthy, Only one credit card three years old with perfect payment history.

I have a total of three revolving tradelines with perfect payment history. I am using about 20% of my credit between my three credit cards. I have a payed off bank loan with perfect payments over a two year history.

    Here is my derog items:

Client: Commonwealth PR Account Number: XXXXXX Date Reported: 10/2001 Amount: 81 Balance: 0 Balance Date: 10/2001 Last Activity:11/1998 Date Assigned: 02/1999 Collection Status: PAID Whose Account: INDIVIDUAL ACCOUNT Collection Agency Information:

    Gold Key Credit, Inc.
    625 US Highway 1 Ste 102
    Key West,FL 33040-5603
    Status Date: 10/2001 Note:

I never really found out what this was from. All they could tell me it was from an insurance company that I had a auto policy with. How I end up owing them money is beyond my thoughts. I foolishly payed this off in full without requesting deletion.

During CHOD. Do I send my validation(nutcase) letter to Gold Key Credit? I have the letter already typed out and ready to go. I know I have to wait until the Nov25 before sending it certified mail.

    Next derog:

Client: Now Care Medica Account Number: XXXXXXXX Date Reported: 10/2001 Amount: 159 Balance: 0 Balance Date: 10/2001 Last Activity:03/1998 Date Assigned: 11/2000 Collection Status: PAID Whose Account: INDIVIDUAL ACCOUNT Collection Agency Information:

    Credit Control Corp
11825 Rock Landing Dr Ste A
    Newport News,VA 23606-4236
    Status Date: 10/2001 Note:

I found out this was from an unpaid medical bill that should have been payed by Workers Compensation but was denied for some reason. Once I found it on the report. I again foolishly payed this one in full like the other derog without asking for deletion.

Do I sent my nutcase letter to Credit control Corp?

    Past Due: $796
    Credit Limit: $0
    TOOLS
    >Status as of 10/2000: Charged off as bad debt<

This one was purely my fault. In my former life before a bad accident in late 99. I was a mechanic that opened up a credit account with the toolguy that came around the shop everyweek. I ended up owing them some money after I had returned all of the tools. I let them call me and call me. But I was broke at the time and could not do anything.

I did a settlement with them for a little over 50% of $1000.00 left over. They have not reported the settlement as of yet. It has been 4-5 months at least. I again foolishly did the settlement without requesting deletion.

Do you all think it would be in my best interest with the settlement being so close to send the nutcase letter during this years CHOD? Or wait until next year and let some time pass?

I would like to get the two small accounts taken off my credit reports this year and possibly wait until next year for the snap on account.

One "kinda" derog. (Hard inquiry not intended for me)

    05/29/2002
Individual AMAN COLLECTION SV-D OF Permissible Purpose = COLLECTION

I called Aman Collection and asked what this was referenced too. All they could tell me was that it is not me. There is another man in my city with the same first and last name as mine. Funny thing is we have both lived in the same house. He is twice my age, different race, and doesn't like to pay his bills.I have found this out by doing some investigating after I started getting bills that were not mine. Same name, but nothing else matched. My theory here is they pulled the CR by name and City and hoped it matched up by grasping straws . I never did recieve anything from this company about whatever account he has defaulted on with them.

I have spent over three hours on the phone with them and they refuse to remove the hard inquiry off my report, saying they do not do that for any reason. What is the next step I can do?

After I send out the letters. If they do not respond what is the next step? Do the Collection agencies have to prove they sent the validation forms back to you within the time? Or can they just say they sent it without proof?

    Thanks for you guys/gals time.

    Chris

First off, dispute everything as NOT MINE with the CRAs. CHOD is coming up - wait until then for the hardest ones.

***** I think you are safe with keeping your credit usage at around 20%, do searches on "credit usage" , "debt ratio" ectectectect

**** Ahhhh I love medical payment disputes.. I would attack any and everyuone on this, especially the hospital/clinic who turned it over to collections.. how did you pay for it? I don't know a clean way to deal with this... I had 3 medical collections "unpaid" in which I dealt mainly with the hospital in this case and made sure that they got the CAs to remove any and all derogitory remarks, ***get everything in paper***

You mention CHOD several times in your post, and I think you may be a little confused about the primary goal. This is a time when you want to dispute directly with the CRA's. Don't bother with the nutcase letters until after you have disputed (probably as Not Mine) and it comes back verified. There is a good chance that at least 1 or 2 of your collections will come off this way.

Regarding the unauthorized inquiry, I would prepare a letter informing that company that they are in direct violation of the FCRA and that you expect immediate removal of the inquiry or you are filing suit. This is potentially a $1,000 violation so you shouldn't have any trouble getting them to remove it.

It seems I am a bit confused as to what I have read.

So during CHOD I am to claim not mine status on the collections that I have paid off?

    Thanks

    Marc,

I'm a newbie to this board, but not a newbie to message forums in general.

Regarding CHOD I have prepared my letters to go out all claiming not mine on the collection accounts/chargeoff. Lets see what happens with those.

I guess I should have laid out my question again instead of hoping people had telepathic powers and could read my mind.

The unlawful hard inquiry by the collection agency is what I have questions about. (Yes I searched and found one instance but didn't exactly educate me fully on the subject).

I have spent hours on the phone with them regarding this. Being transferred from one person to another, all saying we don't remove them. In one post somebody mentioned a letter used by somebody, and that the person who made it up/used it got a check for 1K.

I am tired of playing phone tag and now want to play hardball with them. Are there any example letters somebody has written up that could be used in my case?

    Thanks guys/gals

    -Chris

there sould be some on the board somewhere. Email or post to Butch, i know he has one.
Also do a search on "PP" or "permissable purpose"
Both Marie and Quixote have excellent threads on this topic.

There are quite a few posts with letter dealing with the unauthorized inquiry on the board. When you do your search type in "unauthorized inquiry" or "permissable purpose". That should pull up a lot.

Also, go check out Christine's site at www.bayhouse.com . She successfully made Wells Fargo fold for an unauthorized inquiry and received $1000 buck in the process. I believe that quite a few creditnetters have used that letter (modified) of course, to deal with unauthorized inquiries.

Welcome to board, by the way!
