re-aged arrow

    let me tell right away, that i have jsut spent hours reading up about arrow, trying to figure out how to file suit. and i just came across soemthing i overlooked. looking at an old equifax report i notice arrows acct is mentioned as 'last activity 12/95', which means it fell off. they now re-reported and changed the date of last activity to 12-97.

    here's my question: i can prove to equifax, that the sol is over, but i don't have old tu and experian reports, so how can i prove to them, that the sol is past? can i give them ocpies of my old equifax report? is that something they have to accept?
    (of course blacked out anything i don't want them to see)?

    I'm assuming that you have throughly tried to validate with them and now, due to their non-response, you have decided to file suit.

    I would just write the CRA's and dispute based on the date of last activity. See what happens, and if they verify, I would just start filing suits. THEY have to prove what your DOLA is. I doubt they can prove it as being 1997, when in actuality it is 1995. This actually sounds like a slam dunk to me.

    You can give this a shot...just be sure you have created a strong papertrail. You also need to make sure you have tried to resolve this with the CA so both parties have notice that you are disputing the account. Don't just send a letter or two...try everything you can think of to get it resolved before filing suit and make sure everything is well documented, including dates, phone calls, names, etc. This will give you a *lot* of leverage.

I don't do the site anymore and I think Christine has it as read-only, but the complaint and various pleadings are there under the link Seidman v. XXX and Experian. This case was filed because I disputed with Experian and the OC and the account was re-aged.

    Feel free to edit it to suit your purposes. (There are links to the Summons, Complaint, letters, etc.) Being served with a summons to US District Court is often times a wakeup call and where they weren't paying any attention before, frequently they will rush around to cover their behinds and resolve the problem as quickly and as cheaply as possible.
