lawsuit help needed

    i have sued 'equifax, inc.' beginning of the year and now got a letter from their attorney, saying, that they're not a credit reporting agency and that they have noting do do with ce\redit reporting, except maybe through one of their subsidiaries, equifax, information systems, llc (same address). Also, i sued the ceo as well, and the attorney claims, that the ceo has absoutely nothing to do with this and according to the law i will be liable to pay his legal fees in this suit.

    Looks to me as if they're bluffing. Isn't equifax, inc still responsible for this, since they're the mother company? Aren't they responsible for their subsidiaries?

    they did include my credit report with the answer, which would negate their claim of not having anything to do with credit.

    I would love some feedback on this, please

    You needed to sue Equifax Informaion Systems, LLC. While they might be affiliated with Equifax, Inc...they are a separate limited liability corporation. Also, he might be right about the attorney fees for the CEO. One of the reason corporations are formed is to limit the liability of the shareholders. The CEO would have no personal liability in this situation. You might want to dismiss and refile correctly...maybe do a little research first.

    Hi Varinia,

    Finding just the right entity to sue CAN be a tricky issue. These people are experts at dodging and weaving.

    As Whyspers points out, a healthy amount of research is required.

    Here's a site that may be of help to you. If I remember it has a section on isolating your lawsuit target.
