I disagree, plenty of good suggestions in that thread. Sue them, that will get their attention. Never heard of a dead man filing a lawsuit. When was the last time DH got his license renewed? If it was since this whole incident then send them a copy of it. Get a new passport, that may help or again SUE!
khm do you have the link to the thread you all are referring too? also, if i were to send a copy of drivers license, where would i send? to the oc or the cra? please help! any suggestions appreciated! peace, jimrie
Re: Re: Getting Back on Track!!! This is the thread that I was referring to: http://consumers.creditnet.com/straighttalk/board/showthread.php?s=&threadid=41038&highlight=dead If I'm understanding everything correctly, this is an unpaid CO you are trying to get removed, and NCO never validated--they just executed him? My concern is, if you send it to the OC, might you wake them up to collection again? Sounds like your between a coffin and a hard place.
whyspers, you've got a lot of experience in this regard -- what are your thoughts regarding making judgments about when versus when not to call. We see so much on the boards about keeping it all on paper, yet at other times we see that idea deemphasized. What's your operating philosophy regarding this (and I realize that there may be no hard and fast rule)? Doc
Re: Re: Re: Getting Back on Track!!! OMG T, you aren't serious??? I havent' actually run across anyone who spelled it with a "C" yet!!!! How cool is it that it's you? Well, other than all those people over in Ireland I haven't seen it spelled with a "C", lol.
yes, doc, i would appreciate that answer to from whyspers. thanks all for the suggestions, i really do apprreciate the time it takes to respond! peace, jimrie
I was refering to the links posted up top by Jimrie. Is this debt past the SOL? Do you have a nice papertrail? If yes, then I would call. As to the license deal, I would send it to the CRA that has him listed as deceased. How much is this debt for?
Re: Re: Getting Back on Track!!! LOL, I reread that post (that I linked to) 4 times, trying to figure out what you read that I didn't.
Re: Re: Getting Back on Track!!! Okay, was not going to get into this further, but...look...you have to use a little common sense here. Sometimes a situation will call for a telephone conversation, simply because writing back and forth or faxing back and forth is just not practicable. It can be time consuming and believe it or not, sometimes a telephone call can resolve the situation much that letters never could. Also, if you have your papertrail, who cares if you have a telephone conversation or write back and forth? Won't change the facts of the case and won't change whether or not they have already made violations. I think some of the confusion comes in when people are trying to get things removed from their credit report that are actually correct and/or they are trying to work with an account that is still within SOL. If you don't want a CA calling you...then its a good bet that you will want to keep things in writing. On the other hand...if you have a situation where you are in the right (i.e. your hubby is not dead and they are saying he is), there is no reason for you not to call if you want to. Afterall...the whole idea is to correct the incorrect info...correct? Now if your goal is a bit more ambitious...and you are wanting CCB to delete this account and not just remove the deceased notation...you may want to take other steps. That is your call. I have always done both...sent letters CRRR, sent letters regular mail and talked to people on the phone. Made no difference in the lawsuits I filed. L
Re: Re: Re: Re: Getting Back on Track!!! Well, I thought I was being different until I found out the day after I signed the birth c. that there was a car spelled the same!!! Humppphhh!
Re: Re: Re: Re: Re: Getting Back on Track!!! LOL, yeah, there's a perfume spelled the same way I spell DD's. Do you call her Cici?
Re: Re: Re: Re: Re: Re: Getting Back on Track!!! I don't, but when she was a baby that is what all of the other kids called her when they could not pronounce her name, then her dad started calling her that, so it has stuck in a way.
Re: Re: Getting Back on Track!!! whyspers i appreciate the forthright answer, and i do understand that common sense comes into play - just trying to make the best decision - and what i do appreciate more than anything is the number you gave me someone else asked if it was passed the sol from what i can see here http://www.fidelityinfocorp.com/state_list.html the sol for our state of south carolina is Open Acct.: 3 years Written Contract: 3 years the date of last activity on the tradeline is 06/99 - so i am gonna assume that it is passed - but i am not quite sure this comes into play either (???) it is a tradeline we are working on iliminating - and like whyspers mentioned in the post, i don't want this creditor calling us. so i would rather handle everything in writing sunshine made a point - wondering if i should take that route, and send to the address listed in the post - does that sound reasonable? Aimee Sligar Executive Relations Manager 800 Delaware Ave Wilmington, DE 19801 ******** different line of thought, does anyone believe handling this with the cra would be a better option so as not to wake a sleeping dog? jimrie
