Contacted CA - Is This Good?

    When was the account closed, by whom, and why?

    Who were the payments being made to on the CLOSED account.

    What State are you in?

    The account was closed by the OC because there were payment problems in the past with this charge card when I was married. As for when it was closed, it had to have been at least 3 or 4 years ago.

    The payments were being made to the OC.

    I live in Pennsylvania.

    I'm confused again (surprise surprise). How come a CA is already contacting you if it hasn't been charged off yet?

    Are you getting statements from the OC? Have you tried calling the OC to see what the balance is? Can you continue making the payments? (monthly to the OC) what about offering a payment plan to the OC and in exchange after 12 months of on time payments they reinstate your CC and mark it as pays as agreed/never late??? Or just mark it as pays as agreed and NOT reinstate it?

    At this point I think its safe to say you're still within the SOL and CAN be sued for the entire balance. Just because they closed it 4 years ago doesn't mean anything, it's the delinquency dates that result in charge off.

    Maybe copy and paste what is posted on your CR about this one tradeline and xxx out the acct. info, just so we can understand this a little more.

    Maybe its the new thing. I got a letter from a CA from Household for a 60 day past due balance $20 whopping bucks.

    Four20,

    Don't forget, it's not possible for a CA to list an account positively. There mere fact that it's from a CA makes it negative no matter what it says.

    I can't go to a proctologist and then tell everyone it wasn't because I had with my butt. LOL

    It MUST be entirely deleted or no deal.


    BTW - Four is exactly right about Check-by-phone. Don't do it.

    No, they were going to ex-husband's address.

    I contacted the OC and they told me I needed to contact the CA. OC would not give me any info.

    I wasn't making payments on this account ex was. This was part of the settlement agreement in our divorce - ex responsible. I am struggling now with my other bills.

    OC didn't want to talk to me when I called. Referred me to CA. I am sending a validation letter today because I have never received anything from OC or CA since this account has been delinquent.

    This is what it says on my credit report.

    I know I didn't type what I meant as far as paid as agreed...that is on the part of the oC, of course.

    .. when was the last time YOU made a payment.. find out what the SOL is for PN.. if it has past, then they shouldn't be able to come after you.

    Send a validation letter ASAP.. make them prove the debt yours and you want an itemized list of all the charges, fees, interest, etc.

    Start there and we'll see how it goes

    I would say you are no where's near the SOL if it hasn't charged off yet.

    Have you tried disputing it with the CRA's??

    What I meant by continuing the payments, could you take them over and go after the hubby?

    BTW-isn't your husband in contempt of court? How about filing for an ex-parte relief?? In my state that is something a judge rules on the DAY you file in court.

    The last payment made was in September of 2002.

    I haven't disputed because there is nothing to dispute. The charge card was not party to my settlement agreement which makes me and the ex-responsible. I am primary on the card.

    I can't take the payments over - I don't have the money to pay it.

    My ex is in contempt of court. I did hire a lawyer to go after him but I found out he got his car repossessed and isn't paying any of his bills. My ex has nothing so I can't go after anything.

    I am sending a validation letter to the CA.

    I wish you the best of luck with this.

    My ex filed bk while we were still married and didn't tell me until trial. Now, even though I haven't filed (not since 94, anyways) The last account of his showing on my report is a repo that is reported as Inc in bk. I have tried to dispute this as: not mine (I have totally diff name now), not responsible for this (sent paperwork from bk court...long story), and as not filing bk...still comes back verified every time. The last time they verified, they changed my name back to what it was on my cr and put an address where HE used to live as my current address (2000 miles away). Took a few calls to starighten that one out.

    So, it looks like I am stuck with this on my report.
    When he filed bk, he said all of the debts were joint, but on the schedule H which lists other responsible parties, he left it blank. My arguement is that the creditors saw this and had the opportunity to contest the bk, but never did, thereby accepting that he was taking and filing on the debts in full. Oh well...don't think I will be able to convince anyone else of this, though.
