When an OC verifies incorrect info?

    I recently had 4 accounts on my TU report showing as "charged off as bad debt" when in reality they had all been discharged in BK in 1998. I disputed all 4 accounts with TU by stating that these accounts had been discharged in BK (which is not the best dispute, but I know better now...) The OCs all reported back to TU that the accounts had been charged off but did not mention that they were included in BK. Here is what they reported to TU:

    Bank America #1: Payment after charge off/collection; sold to NCO Financial
    Bank America #2: Payment after charge off/collection; sold to Commercial Financial Services
    MBNA: Payment after charge off/collection
    Local Credit Union: Verified with no change (still a charge off)

    What should I do now? All 4 of these creditors were listed in the BK and were mailed notices of both the filing and the discharge. Upon receiving the dispute from TU they had the opportunity to either correct the listing or delete it, but chose instead to verify INCORRECT and INCOMPLETE information on my credit report! Suggestions anyone?

    first of all, lets make sure TU did really investigate. I would send a procedure request to TU to be on the safe side.

    I would then be prepared to take action against OC... I am assuming you want deletions?

    I am not a BK expert, but you definitely have a cause of action under the FCRA.

    AND you can file motions to have the OC's in contempt of the bankruptcy court discharge order.

    Yes, I want deletions. To "bolster" that cause of action for a possible future lawsuit, would you recommend that I also dispute these items directly with the OCs prior to going to court? (This might result in them simply changing the listing to included in BK, which is not what I want...)
