    Ok,

    Experian has denied my disputes three times in a row therefore I can rule out a "clerical error" defense. I'm ready to sue and am going to. I just need to know who here has sued Experian successfully ? What forum did you sue in etc? I think PsychDoc got them to settle so I'm curious about that also. Let me know thatnks... I'll keep you updated with my suit.

    The diva sued eXP in small claims.. won cash ( no deletions) The diva then threatened to sue in Federal court ( got deletion).

    Quick question: If you sue first in small claims, can you then sue for the EXACT same thing in federal court? If so, then why wouldn't everyone try the easy route of small claims first and then proceed to federal only if they didn't get what they wanted in the small claims decision?

    Can you describe the basis of your complaint ? Also please summarize the small claims trial as well as you action/basis for a Federal Trial which got your deletions.

    you cannot sue for the same things, but you can sue for violations that occur after your small claims suit is filed.

    I filed for "multiple violations of the fair credit reporting act" that is all I put on my complaint.

    I had a fully listed chronology of all my letters and events for small claims, plus copies of FCRA with relevant sections highlighted for myself and the judge. EXP did not appear, but I had to present my case and prove damages (had denial letters) to get my default judgement.

    However, even though they had information that the account was incorrect, they ignored my evidence (after the small claims suit) and then refused to investigate. I used Whyspers lawsuit as my template and wrote a complaint for federal court. They contacted within 48 hours or receiving my overnight letter. They contacted me but did not want to settle. I reminded them that I had pursued this same matter in small claim and had a definite cause for (willful noncompliance) since they refused to investigate. Needless, to say, the matter was settled in my favor!
