I got an email from a guy wanting to know if he was sued by a CC company if they could take his house, and I told him the great state of Texas has the homestead exemption, but he wanted to know if they could still put a lien on it? I wasn't sure, so here ya go!!
Yes, they could. If they obtain a judgement and filed it in the real property records of the county he lives in, the lien attaches itself to any real estate he owns at the time. It creates title problems if and when he goes to sell the property and the lien is still unresolved.
