Question about one spouse filing bk

    I have a couple of questions to anyone who has experience with just one spouse filing bankruptcy.

    - Is the income of both spouses considered? I'm assuming yes.

    - When making a budget to (hopefully) qualify for Chapter 7, can the credit card minimum payments of the spouse who is not filing be included since they are not being discharged?

    Laws vary from state to state and only an attorney in your area is qualified to answer your specific questions. Typically, yes both incomes are considered and you can list minimums for credit cards that are in the other spouse's name.
