So far I have had success with 1 of 2 DV letters to CA's reporting on me. - The one that did 'validate' simply sent me the most three previous statements as of DOFD. Even though the letter came from the Original Creditor, and I sent the DV letter to the CA that was reporting, they pretty much had most of the info I requested. - The one that could not validate said that they were not able to validate at this time, and that they would cease collection activity until they could. Also mentioned in their reply letter, "as a courtesy we have requested that the CRA's delete the account from your credit file." Now, how long do they have to do this and how long does the CRA have to remove after they have been notified by them? Also, should I send a letter to the CRA myself with a copy of the reply from the CA just to be sure? This was my biggest negative account, and VERY MANY THANKS TO MINDCRIME FOR ALL HIS HELP AND ADVICE!.
I would dispute it through the CRA, because if they delete it, you aren't protected from re-submission.
Hi, thanks! I will dispute with CRA too then as you said. But also just wondering is it possible for them to re-submit it even if it is past SOL?
Past SOL, yes (at least usually). SOL is based on your state and has nothing to do with the Running of the Reporting Period (7 years). And you could probably just dispute it online with the CRA and save the postage. The CA won't verify it and the CRA doesn't need the LTR.
Oops, too late. I already printed a letter about the CA saying they would report it for deletion, and attached a copy of the letter and highlighted that part of it. It's still sitting in the outgoing mail box at my work if you think I should not mail it and do online instead.
It's okay, won't hurt anything. The CA admits they have no evidence you owe anything and therefore the account is invalid. Online is just quicker, cheaper, and you can print when you submitted the dispute, but mailing it okay too. Either way, the CRA is going to open an 'investigation'...
